I now know what paypal is ,after an exhaustive 3 day's I've got on line banking, and paypal, plus my credit card! In between all this the seller would not answer repeated emails regarding all this I have bent over backwards trying to resolve this, received 2 emails from him,one saying just pay me and don't waste my time, and the biggie I could have let someone else buy it ,my repeated emails are all unanswered, now he's filed a non payment with ebay against me !!! That was it for me I no longer want the item nor will I do this again, yes I know ignorance of the law is no defence (ebay) in this case. messaged seller informing of my decision ,no response any thoughts on this would be appreciated thanks. kig

You should ensure that you everything lined up before you start shopping on ebay (PayPal account etc...).
Having "0" feedback isn't helping matters.... Sellers have a "low" tolerance for Buyers with no feedback and don't want to hear excuses.
I suggest you pay for the item and learn from this experience because you don't want a unpaid item strike against your account. If everything goes well with your transaction, leave the Seller good feedback.

So what's your question?
If you don't pay, then the Unpaid-Item case against you will close automatically after 4 days and the transaction will be canceled. The seller will get their fees refunded by eBay, and you will have a ding on your eBay account for the next year.

That was very rude of the seller not to give you time to set up your Paypal account. Most sellers are more flexible with new buyers.
Since you mention that the seller has already, after less than 96 hours, opened an Unpaid Item Dispute, I'm guessing that he is in the USA?
In addition to your horrid sins of being a newbie to eBay and not having a PP account already set up, you add the obvious evil plan of being Canadian. Is there a Yankee equivalent to 'the wogs begin at Calais"?
Sigh. Okay, the PP logo that shows on many listings makes it look like you can pay the seller with your creditcard, and as you learned,it's not as simple as that..
At this point, you can not pay and get the strike dennis mentioned or pay, get the item you wanted and .... leave appropriate feedback.
The most effective feedback is calm and factual. "Badgered me until PP account set up Multiple emails Unpleasant person" sounds about right.

Since this is your first transaction I highly recommend that "you pay" or you will definitely receive a unpaid item strike against your account which may include a possible account suspension.
Unfortunately, the seller could have handled it better since you continued to communicate with them.
If the rest of the transaction goes well, item is shipped in a timely manner and arrives well packed and as described then leave appropriate feedback.
Remember you are in the "power" position if "you pay" as eBay will side with Buyers more then Sellers.
Chalk this one up as a learning experience and move on to greener pastures.....
