What now?? Returned item to seller who is not responding !!!

Ok, I ordered an item at the beginning of December from China. Due to holiday post slow down, I rec'd it just before the new year. Item did not work, seller agree to refund item. I returned the item on January 4th and now, the seller is 'away on holiday' for another WEEK, and my time has lapsed in regards to leaving negative feedback!!!! Furthermore, I opened a dispute through paypal and it said it wasn't covered, even though it clearly says the auction was!!!!!!!!!!!!!!!!!!!

I've already returned the item and am out the return shipping as well as purchase price--what else can I do? I'm really pissed!! I've emailed the seller a million times and keep getting a generated 'out of office' message.

Any help would be greatly appreciated.

You have to open a dispute within 45 day so it is too late to do that. If you paid for the item with a credit card through paypal, you might be able to do a chargeback with your cc company. Other than that, there isn't much that you can do other than to keep contacting the seller..

The problem with buying items from China is that if there is a problem and you file a claim, you have to send it with delivery confirmation so that you can prove to paypal that the seller received it. That means sending it with xpresspost which would cost $65+
