Anyway, on June 5, I sold a set of saw blades to a new Ebayer (1 feedback) in the US (I'm in Canada), on June 17, she still had not paid, so I filed a NPB, on June 21, she pays for the blades, on July 1, she files an Item Not Recieved complaint, after I told her it would take at least 2 weeks to receive the item via Small Packet, which comes with a $ 100 ins but no tracking number. So I refunded her money 2 days after the complaint and told her I would file a lost package claim, and of course she emails me back 2 days later to say she's received the item and would like to keep them, and would like me to resend an invoice for her to pay for the item, it is now 10 days later and I haven't heard back from her after numerous emails. I've contacted Paypal & Ebay but so far no response, I'm not sure how to go about this, can I file for a Mail Fraud Complaint with the Post Office?
Its really frustrating because the buyer has a lot of inconsistencies with her story, like in the NPB forum she says "I sent my payment about a week ago and wants to know if it has been mailed", when she she actually paid 2 days before, and how she told Paypal she was never contacted about shipment information but she replied to the email I had sent her about the shipping information because the previous emails showed up at the bottom of the newest email. I'm not sure if she's just not all there or if she's trying to get what she can for free?

When a buyer claims non-receipt DO NOT do an immediate refund, best way to proceed is to say "I will trace and file a claim with the post office, when they settle I will refund" make it sound sincere and give the impression (which is fairly accurate) that this will not take too much time.
As this was a PayPal thingy you could be screwed anyway but you should go ahead with your claim to Canada Post as they don't usually make any contact with the buyer over a small claim.

Besides what he mentions about "stalling" for time - doing a trace/filing a claim, etc. - I have found that most impatient buyers in the USA (and, there are a lot of them) will accept the explanation "delivery will depend upon how long your USPS take to clear the item thru customs".
Works for me- they back off and wait for the parcel to be delivered in due course - and most end up giving glowing feedback on the fast delivery.

Your best option now is to file for postal fraud - because that's what this is - and this is taken lots more seriously in the US than here. Try sending her a very nice message, leaving her room to back down and save face, but point out that you will be filing a postal insurance claim to recover your money and your concern is that she may run afoul of postal fraud charges when an investigation finds that it has been delivered. Hope she pays - good luck!
