Ripped envelope, stolen item...what to do now?

I received my package from the seller, but the envelope was ripped open and the item I bought was stolen. The seller has tracking and it shows that the package was delivered, so I can't file a paypal dispute because the seller will win for obvious reasons. What do I do now? I called the post office and they're telling me I should contact the seller to file a claim with usps. I contacted the seller, who tells me I should contact Ebay buyer protection...I'm not sure how to contact them though...I have a feeling they're just gonna tell me to file a Paypal dispute...which I will lose. What do I do? Help! Thank you!
