You had 45 days in which to open an item not received dispute.
The process and policy is explained here.
What to do if you don't receive an item or it doesn't match the seller's description
http://pages.ebay.ca/help/buy/item-not-received.html
If you funded the transaction by credit card telephone the customer service number on the back of the card and ask to do a charge back.

45 days
FORTY FIVE DAYS

FFFFFOOOORRRRTTTYYY FFFFIIIIVVVVEEE DAAAAAAAAAAAAAYYYYSSSSSS.
If you haven't recieved your itemm in 45 days or before (40 days recommended) then put in a claim.
If you paid by credit card or bank through paypal, and not from paypal funds,, you may be eligible for a chargeback through the credit provider or bank. Best to contact them
Just as a friendly FYI, it's usuall 90 days for a chargeback to be filed, so don't wait 95 days and then come and post here about why you can't do a chargeback. 🙂
