This seems to be a newish scam from some Asian sellers. It is very likely that no item was ever sent.
You are right, ask for a refund not a replacement.
While the 45 days for a PP /eBay dispute have run out you do have a few options.
You have up to 60 days to leave feedback. At that time you will be asked to leave Detailed Seller Ratings. While a normal transaction should get five stars the lowest mark is ONE STAR. If a seller's DSRs drop below 4.3 his ability to list and to sell will be greatly restricted or even ended.
Your feedback will be most effective if it is calm and factual. "Promised replacement did not arrive No refund No communication." for example.
If you are smart enough to have paid by credit card using PP as the processor, turn the card over and call the 1-800 customer service number on the back for a Chargeback. Have all your details ready to help the clerk make the refund. Cards have longer deadlines than PP, but they do have deadlines so act immediately.

I got the same problem. Seller promised to resend the item. I patiently waited and waited till the term of application passed. Moreover, after what the seller has never replied me back. I lost my $90. I think the ebay under-looked the terms for the case opening. Or another ways should be created to protect customers. Please, do not wait when seller resend your item, open case immediately!!!! Be aware of Asian sellers!!!!

I had exactly the same problem, but for some reason i can not reopen the case...

But the problem persists.
If your Dispute times out or if you close it based on the specious promises of a scammer, it cannot be reopened.
Instead go to Paypal.
Their Resolution Centre is at the top of your PP account page under Tools.
Open an Item Not Received dispute.
Skip the Contact Seller, you did that.
Explain the problem. If the seller is NARU (Not A Registered User) say so.
If the seller cannot prove Delivery (not shipping, delivery) you will be refunded.
You have only 180 days from Payment to open a Paypal dispute.
If that deadline has passed, you can try the 1-800 number on the credit card you use to back your PP account and ask about a chargeback. Card policies differ.
