I haven't received my items and its been over 45 days. How do i open a case?

I bought two items way back in August of this year. The seller lives in Belgium, so i assumed that it would take a fair amount of time to receive my items. It is now almost December, and after sending 5 messages to the seller, i haven't gotten a response. I tried to open a case, but its been well over 45 days. How do i fix this? contacting Ebay by phone has gotten me no where.

I have similar problem, but not ebay nor Paypal willing to help. I lost all my money on an item with internal damaged, but I ordered it in September, by the time it arrived, its already over 45 day.

is there any way of emailing ebay and talking to someone one on one? this is absolutely ridiculous. i wouldn't care if i was out $5. but im out close to $50
