Recently I had some problem with my buyer on this item 330118454746

Item arrived, but has some damage.
Buyer ask for full refund or send another one.

I feel it is not fair to me.
In my listing I said very clear, "we seller, CANNOT be held responsible for item damage during shipping because we simply have no control over reckless handlings at airports, or post offices."
And all my package is as described.

I don't know what should I do.

Any suggestion?

It is always the sellers responsibility to get the item to the buyer, in the same shape as described. Insurance is for the seller, not the buyer. I am sure others will come along with their opinions. Just my 2 cents worth.

If you believe the damage was the carriers fault then by all means, make a claim but in no way should your customer be held responsible, in spite of what you say in your auction descriptions. Sorry to sound harsh but, its the reality of selling.

Snoopwiz is right. It is the sellers responsibility to get the item to the buyer. That it arrives damaged is a matter for the shipper to discuss with the carrier. The buyer is entitled to received the item as purchased regardless of on conditions that you might put in your listings.

If the buyer used PayPal to purchase the item, PayPal will side with the buyer anyway. Do the right thing and refund and file a claim with the carrier before it comes to that.

hi doufaceb;
given a neutral scenario, the buyer should be refunded. not like i haven't been there, done that a dozen times. while it isn't the seller's fault that the item got damaged (provided they packed it well), it certainly isn't the buyers. this is an issue between shipper and shipping company, and DEFINITELY file a claim with the shipping company. i hope it wasn't canada post with a fragile item such as glass/porcelain/ceramic...as they won't refund, insurance or not.
on the other hand, if you're a seller who clearly believes and states in your listing you will not refund for lost/damaged items, you have every right as a seller to have whatever terms you feel necessary. buyer should also be aware of this. however, if you do refuse, and buyer goes to paypal, they may win (apparantly, according to others, as its never happened to me before)...anyways...good luck...let us know what happens...

The buyer is not at fault here. It is the seller's responsibility to provide the buyer with the goods he/she has purchased, in the condition stated at time of sale. Always insure if you can't afford to bite the cost of damages.

Always, always, always the seller's responsibility. If you have packed properly than and damage will be refunded by the carrier.

PayPal will give the buyer his money back if he makes a claim.

Just A question.

In some case:

If a buyer suddenly changes his mind and want to refund item after he opened/used the item.

What he should do is to break it and claim the item was damaged in the shipping. Then file a clam to get fuul refund.

Is it easy?

It's always possible but, fortunately, most eBayers don't practice that kind of deception. It does happen on occasion when someone thinks they can mess with the system.

One measure you can employ is to ask the buyer to photograph and email to you pictures of the damaged box. It is interesting how many buyers (over the years) that have initially claimed damage, have disappeared when I have asked for these photos... never to be heard from again.

hi doufaceb...definitely wait for the pics before considering a refund...as bill said, they do disapear after asking for photos...its happened to me many times, and yes, the contents of the box can be damaged without necessarily always damaging the box itself, especially when you're dealing with fragile items AND canada post!

Certainly it's possible for the contents to be damaged without external damage to the box - it usually happens when the contents are not packed to restrict internal movement. That said, my point was that many frivolous claims will dissipate into the mists when challenged by asking for photos. if the claim by the buyer is legitimate they will work with you (normally) and supply images. The images of damaged packaging can often be used to support damage claims - especially for international packages.

By the way, I don't sell china but I have sold many collectibles over the years.

What happens when the buyer already has the same figure they bought from you? Why would they buy another? Because they broke their original. What they may send to you are photos of the original one they broke. If you ask your buyer to ship it back before offering a refund you'll get their original broken one shipped and they will keep your nice, new one to display in the old one's place. Try finding a way around that situation...


190108982024 is the object of my wonderful dilemma. My buyer received the item and shipped back to me before even getting in contact with me. It wasn't until I received tracking info before I knew it was coming back. Now the buyer is emailing me daily to maintain relations I suppose and tell me what a wonderful, understanding seller I am for being so willing to take it back. I'm now stuck with a broken piece that I literally have to get dusted for fingerprints to verify if I handled it or not. The hard truth of the matter is the cases these pieces ship in are near indestructible. Form-fitted inner foam sealed in a wooden box surrounded by a 1 1/2 inch slab of more foam surrounding the wooden box inside the display box that is further surrounded by 2 inches of shipping peanuts before being encased in the shipping box.


Sorry for the hijacked rant but I feel for you doufaceb... I don't want to refund this one because it reeks like rotten death.
