what can you do if you paid for an item by check and more than 45 days pass waiting for the item to arrive and never comes?

I bought an item from canada and paid with check .I waited more than 45 days for the item to arrive and never did.I can 't report the case since more than 45 days passed and the seller is telling me that he send the item that I didnt reiceived.There is anything I can do or ebay and the whole trasactions that take place on it is just a fraud.There is no ebay phone I can call or email to contact Any suggestions?

That is why cheques are not an authorized payment method on eBay Canada or eBay.com

Even if you had opened a dispute within 45 days eBay could not have helped you because you used an unauthorized payment method.

I understand cheques are permitted on the UK site but your banking laws and consumer protection laws are different.

Has the cheque cleared yet?

If not go into your bank and put a stop payment on it.

If seller shipped surface mail could take a couple months to arrive.
