eBay closed a case without refunding me return shipping (Item not fit description)

I bought an item that does not fit description and arrived broken. So I opened a return request. The seller took a week before telling me that I could probably buy the return shipping label, and it would be refunded together. So I shipped with myself purchasing return shipping.

 

A few days after the item had been delivered, the seller still did not refund me. So I opened a case. eBay quickly resolved the case and refunded me item value + original shipping. But where the hell is my return shipping cost? This is not a buyer remorse, and I should not pay out of my own pocket to return a piece of trash.

 

What do you guys do in this situation? I would appreciate some help. Thank you.

I opened a case early enough to get item value + original shipping, but not return shipping.

HUH?

There are two reasons for returns

The item is Not As Described.

OR

You don't like the item.

You have 30 days from delivery to open a Dispute for either reason.

There is no other time limit.

If the seller messed up and sent the wrong thing, (you bought a red sweater and he sent a blue one --or a hockey stick) he sends you return postage.

If you don't like what your received (you bought a red sweater but it is cherry red and you wanted scarlet) you pay for return shipping, since your preferences are not his responsibility.

 

Your seller was.... I hate to use unParliamentary language.... only vaguely acquainted with truthfulness? Practicing his Trump imitation? Prevaricating? Distracted because his pants were on fire?

Well, it isn't actually.

The buyer is sometimes required to pay return shipping, and at any time can do it voluntarily.

One claim is a strike, plus another from policy violation.

Not exactly.

If the seller settles the Dispute or if the buyer closes or lets the Dispute lapse, the seller has no Defects on his account.

Policy Violations always get Defects.

 

Partly this is jargon.

Buyers get Strikes.

Sellers get Defects.

Thank you for further explaining, but what is called "settled" or "let it lapse" in this case? Because I will prevent this from being settled as much as possible. Here are what I did:

 

1. I opened a return request - normal thing.

2. I opened a claim when he failed to pay me after the item arrived, and eBay reminded me they could step in - and won it. Because eBay refunded me, he naturally got a defect.

 

Yes I know that under buyer remorse the buyer would have to pay for return shipping. Not in my case though, where he sent a wrong, broken item, and especially because he agreed to reimburse return shipping, and then chose to ignore me, thinking customer support can't see our messages - well, they do. So out of my respect for the truth, I simply reported scam.
