6 month's isn't enough time for dispute resolution when the seller does not ship the item promised.

I purchased an item from  on ebay. Its was the Assassin's Creed Syndicate Big Ben Edition Pre Order.  He accepted my $214.98 Canadian dollars and said that when he received the item upon it's release in October he would ship it to me from the UK.  I am still waiting.  He was very nice and communicative UNTIL the promised arrival date came and went.  Now when we pursue our rights with ebay to file a dispute for recovering our money and commenting on the sellers fraudulent ways, we are told it is past the 6 month window.  Ebay said to call Pay Pal. We called Pay Pal, they too have a 6 month window of opportunity.  My credit card company even now says they may not be able to help me recover my money because we waited too long. The seller asked us to wait while he received the item, and reshipped it to us in Canada from the UK. This seller has a glowing reputation on ebay, ONLY BECAUSE they say it is TOO late for me to tell the world what he did to me.  Policies are good, but there needs to be other ways to follow up with people who steal, deceive and are involved in fraudulent activities, but are then protected by "windows of opportunity".  I'll let you know how this turns out, but beware the 6 month windows!!  Written by Linda Pawlowitsch, person out $214.98.

i believe no pre-order is allowed to be 6 months. i think there is a shorter window when you are allowed to offer pre orders. i for one would have never did it that far in advance, i recommend talking to your seller and keep at them until you receive your item or a refund from the seller. after 6 months you have no recourse at all, as you are finding out..

Hello Linda,

I am sooooo sorry this happened to you.  That is a lot of money to lose to a scammer.

<<He . . . said that when he received the item upon it's release in October he would ship it to me from the UK. ... He was very nice and communicative UNTIL the promised arrival date came and went.>>

That is always the way, and that is why you must be sure to protect yourself.  To begin with, why ever did you wait so long?  There is nothing I or anyone else here can tell you because clearly you have exhausted all your options.

For paypal the limit is 180 days to file a claim.  You have also gone past the deadline for your credit card.

<<Policies are good, but there needs to be other ways to follow up with people who steal, deceive and are involved in fraudulent activities, but are then protected by "windows of opportunity">>

I understand your fury and indignation.  Sadly, the rotten horrible fact is that you waited too long.  I wish you had learned this hard lesson for a lower priced item.  Most everyone has something like this when they are new to ebay, - waiting forever for a no-show item.   But those are usually cheapo items from overseas.

As a refresher I will point out the links referring to 'pre-order' items.  Paypal cites a limit of 20 days, -- that the item must be available for shipment 20 days after purchase:

https://www.paypal.com/selfhelp/article/FAQ1488/3

Ebay says the item must be ready to ship 30 days following payment:

http://pages.ebay.ca/help/policies/pre-sale.html#policy

I know you've seen this link about what to do if there is any sort of problem, but I will include it for good measure anyway:

http://pages.ebay.ca/help/buy/item-not-received.html

And as I am sure you are now well aware, Section 13.5 of the following paypal link explains about the need to file within 180 days of payment:

https://www.paypal.com/us/webapps/mpp/ua/useragreement-full#13

On the off chance the seller left you any feedback, you can always reply to it, although I doubt if someone like that would have bothered.  Maybe it is for the best.  You would not want your future 'good' sellers to think you are the kind of person who holds a grudge for all eternity, -- even though your loss was substantial.

<<This seller has a glowing reputation on ebay,  ...it  is TOO late for me to tell the world what he did to me. >>

For this transaction, certainly.

You only ever have 60 days in which to leave feedback.  That means if you have an item sent by Surface Mail, which can take up to 3 months to arrive, you would not be able to leave wonderful feedback.  Instead the only option is to send a thank-you note.

I wish I could tell you something soothing but there is no remedy for this.  It will be of no consolation, but try to think of the many people who have sent 5, 6, 8-thousand dollars or more by wiring the money for a mint-condition car on some of these less reputable sites, only to find out the car never existed and they have lost all those thousands forever.

Best wishes for the future, and truly sorry for your loss. Smiley Sad
