Getting a refund for fake merchandise, when seller said "Returns not accepted" in the auction

Recently I received counterfeit Pokémon cards from a seller and it was a substantial $ amount. I asked the dealer for a refund due to the item not being as described and fake, they said not until I send the item back to them. The seller put "Returns not accepted" in the auction, with eBay's money back guarantee an I obligated to send the merchandise to the seller to receive my money back or will eBay enforce the refund right now?

In short, 'no' if you are positive they are counterfeits.

Go to the Resolution Centre today right now and open a Significantly Not as Described case. 

Counterfeits do not have to be returned. If the seller really wants them back, he needs to pay return shipping for it not you.

Doing this via ebay is what you need to do. Paypal has different rules for its Resolution Centre but if the transaction is more than 30 days past your latest delivery date, you'll have no choice but to use paypal to grieve it.

BTW, it is my understanding that Paypal always insists on the return of the merchandise, counterfeit or not.

On the other hand they allow 180 days for return after purchase.
