I won a case as a seller but do agree i am correct?

I shipped out an item to my buyer after he paid and it says on tracking info on ups that they attempted delivery and apparently he wasn't home to sign and accept the package so it said he must come to a nearby ups access point to pickup the package, days past and i keep checking the tracking info online to see if my buyer got his package and still it says he hasnt came to pick it up. Finally it says time has expired to pick up package and it will be returned to sender. Then later that same day it said Receiver refused package and will be sent back to sender. I was kinda confused on why he would refuse my package. The buyer later opened a case saying he didnt receive package and wants a refund. He said he went to the access point and nothing was there and he also claims he never received the ups slip in the mail saying to come pick up package, I said that i provided tracking info multiple times and that he could have went to get it but did not then ultimately for some reason choose that he doesn't want my item anymore. which doesn't make sense as if he is complaining he didnt receive it than why does it say he refused the package. He said to refund him or resend it.

 

I contacted ebay and told them that i provided him tracking info and he ultimately didnt want my package so i should win the case. They agreed and granted me the win. Though they later sent me an email saying i won and its because the package was delivered. Which is incorrect as it wasnt delivered and the fact that he didnt want the package is why i should win. but either way i won.

 

basically i will be getting my package back and dont need to refund him. but do you think i should have done so?

When you get the item back, I would refund him minus all shipping costs.

Whatever the decision on the Dispute, you cannot ethically keep both the item and the money.

But the shipping costs went to UPS who did their job.

Whatever is left of the original payment after UPS has returned the shipment*, you should refund to the buyer.

 

 

 On the Site Map at the bottom of this page, click on M in the alphabetical section. -> Manage Bidders-> Blocked Bidder List.

Add the nitwit's ID to your Blocked Bidder List.

 

You should also go to your Seller Preferences and add an automatic Block against bidders with Unpaid Item Strikes. This will save you a world of annoyance.

 

 

*Sometimes the carrier will charge for the cost of the return. Canada Post is lax about this at least on the doorstep, but couriers like UPS are less likely to be forgiving.

Also you may have to pay duty or sales tax, although as 'returned merchandise' this should not happen and if it does by accident, you can reclaim it from CBSA.

I had something similar happen recently. It was deemed Undeliverable (due to some unknown, unstated address problem at the buyer's end) and eventually came back to me. Once it did, I refunded the buyer in full. I know that I didn't have to do that but I had the item back safely and don't care as much about keeping the shipping cost as I do keeping my feedback positive.

I have no patience for buyers and sellers who show no consideration for the other party and there are many like that on eBay.

 

The buyer showed you no consideration whatsoever and you might take that into account when making your decision.  The buyer really made you work trying to finish the deal.

 

Whether or not you refund is a personal choice and there is no "wrong" decision.
