Item is not as described, what to do ?

I bought a new adapter replacement for my laptop. It's not an original, but the seller advertise it as a replacement with the same model number and also says that it works with my laptop model.

 

It does charge, but the touchpad does not work while charging, tested in 3 different houses. in and out of the city.

 

The seller offered to send another one for free without me sending back the first one which is nice.

 

But before, I tested it with an electrical engineer (making a grounded Faraday cage, ...) which told me the problem is that the adapter is not correctly shielded and another specimen build the same way would not work better.

 

So I told that to the seller which offers to refund 20% of the item price without me resending. The item was about 7$ plus 7$ for shipping. So if I accept his offer, I'll end up paying 12.50$ to trash an item which was not as described, but if I send it back I'll pay about 15$ more just so I don't trash it.

 

According to ebay, There are cases when the item is not as described, that the buyer does not pay for reshipping and gets full refund. Would this be the case ?

 

Thanks for any input helping me learn how to solve ebay issues.

Filing can take a while.

 

Why don't you simply give the seller 2 choices:

1. give you a full refund and you don't leave negative feedback

2. you file a claim and leave negative feedback

 

Give them a reasonable amount of time to decide, ie. 24-48 hours.

 

A smart vendor will likely choose #1, and you have your money back quickly with minimal hassle.

According to ebay, There are cases when the item is not as described, that the buyer does not pay for reshipping and gets full refund. Would this be the case ?

 

A good seller will pay for return shipping or not require the item back if it is defective however ebay can't ever 'force' a seller to pay for return shipping or for the seller to refund without getting the item back. The odd time ebay will do the refund themselves and not require you to send the item back but I'm not sure how they decide when they are going to do that. You could try phoning ebay and see if they will offer a courtesy refund. But first, open an item not described case and see how the seller reacts to that.

 

Do not threaten to give a negative as suggested in another post. If you threaten a negative and want a refund without sending back the item, the seller will be able to get the negative removed and you will get a mark against you.

pjcdn2005 - what is wrong with informing a seller that you will leave negative feedback if they do not rectify a mistake?

 

I could see this being an issue if you are not acting in good faith, if the issue is debatable, etc. and the buyer is otherwise been determined to have been "blackmailing" the seller.  

 

Otherwise, I do not see how this would be against Ebay policy to tell a seller who broke Ebay policy in the conducting of a transaction, that he will receive negative feedback if he does not resolve the matter in a reasonable fashion.

In most cases, ebay requires that the buyer sends back the item in order to be refunded. In my other post I said

 

'If you threaten a negative and want a refund without sending back the item, the seller will be able to get the negative removed and you will get a mark against you."

The buyer is asking for something that is not part of the original transaction

Buyers sometimes threaten to leave negative Feedback if the transaction didn't meet their expectations. Although this can be unpleasant, it's not considered to be Feedback extortion. Feedback extortion is when a buyer threatens to leave negative Feedback unless you provide goods and services that weren't part of the original transaction.

Examples include:

  • Demanding a full refund without returning the original item
  • Demanding a second item without returning the first one
  • Demanding extra items that weren't part of the original listing
  •  

Even if ebay did not have that policy, I would still not recommend threatening a seller in any way (including the threat of leaving negative feedback) to do what you want them to do. I would rather give them the benefit of the doubt that they are going to do the correct thing without being threatened.I know that not everyone will agree with that but I don't like being threatened so I wouldn't want to threaten someone else.
