My seller is lying

I have two questions: (sorry for my poor English)

 

1) If I leave a negative feedback for a seller, am I still protected for a refund (in case of not receiving items)?

 

2) What should I do for the following situation?

 

I ordered $237 US worth beads to same seller who has 99.2% feedback (56,000) 18 days ago. He promised that he would send my package by DHL or by some quickest method. He sent me a tracking number which does not exist.

He said, he does not have some items available, and he can send me something else slightly different; I asked for refund ($25 worth instead). He sent me $2.75 refund instead of $25 which I demanded again and he said, he refunded $22.25. 

On August 4th, he sent me a message asking if I have received my package? Also he told me that he did not send me everything, and he is preparing another package for the remaining items. He never even mentioned me before that he would send me two packages. I am asking him for a full refund; he did not reply me back.

Don't.  There is nothing to gain by leaving feedback at this time.  Do NOT mention "feedback" in communication with your seller.

 

"What should I do for the following situation?"

 

File a claim today with eBay for goods not received.  Do NOT cancel the claim regardless of any promises made by seller until you either have all the merchandise you ordered and paid for or you get a full refund.  You obviously cannot trust that seller.

Hi dear, 

 

Thanks so much for your reply. I talked with Ebay rep, she said, I have to wait for 30 days to claim as it's international shipping (from China to Canada), so I must wait until I have 30 days. Or I can claim through paypal. Any thoughts? 

 

She also said, leaving negative feedback now would help other buyers, what do you think?

You have 60 days to do so from date of purchase.

He sent me a tracking number which does not exist.

From your point of view this is good.

Tracking is only useful to the seller who is hit by a bogus 'Item Note Received' claim. If the tracking on the package shows that the item has in fact been delivered, the buyer loses.

Mind you it does not make the honesty of the seller look good to give you a fake number.

Did you check on the Canada Post website for the tracking number? They deliver for DHL in Canada. (And for China Post.)

 

It is normal for packages from Asia to take 30 days. Occasionally it is faster, but unless you paid (steeply) for Air Mail service, it is unlikely.

Again, once the parcel is mailed the seller has no control over delivery. This does not relieve him of responsibilty.

 

If you have not recieved ALL your beads by 30 days after purchase, open an Item Not As Described dispute (if you did not receive all of them) or an Item Not Received dispute (if you did not receive any of them).

 

I think it would be best to start with the INR, but it can be changed to an INAD if you do receive something but not everything.

 

 

Don't leave feedback yet.

There is nothing like bad feedback to stop a seller from cooperating in any way.

 

Your purpose is to get either all your beads or all your money.  Not to get involved in a urination contest.
