Dear sir

I sent for 2 items listed as android 4.03. The items I now have I find are android 4.22, it may seem to my advantage

since they are updates, however the hi-fi failed on unit #1 and I settled with the seller at a loss of $60. Item #2 now has the word in large red letters DEMO in the the screen. The seller discouraged contacting e-Bay and again offered a partial refund. This time I felt outraged because of the way, to me seemed underhanded.

It is at the last minute, I find the units offered are not the unit ordered,

This is a member to member forum. There are no ebay staff members here.

 

With that being said, have you ever contacted the seller to let them know that there was a problem?

If you have exceeded to deadline to file a not as described dispute, I don't think there is you can do. Perhaps someone else will come along with additional information.

If an item is not as described, and not working properly would be 'Not As Described' you can open a Dispute at the above addy for 45 days after purchase.

This would include receiving an item that is better than described, I suppose.

Paypal/eBay will refund your original payment, once you prove that the seller has recieved the returned item. This means you have to send the item back using a service that includes Confirmation of Delivery. You will not get a refund on the return postage. If you do not return the item PP/eBay will not refund you.

Dealing with the seller directly can be better. Some sellers will accept a picture of the unwanted item (eg- glass item delivered in pieces) or do not want the item returned (usually something very very cheap). Some sellers will offer a partial refund and no return.

Some sellers will ignore you. Some sellers will refuse to help.

If it is necessary to go to PP/eBay for the refund, the company will go after the seller for their money and the seller will have a black mark on his selling account.

 

You can leave feedback for up to 60 days. The most effective feedback is calm and factual. "Ordered 4.03 Recieved 4.22. Partial refund only" would give other buyers a picture. As well as negative feedback, you can leave neutral feedback.

In addition, you can leave Detailed Seller Ratings. Normal transactions get a Five Star Rating. Horrible terrible transactions get a ONE STAR rating, which is the lowest. You can combine ratings. For example, a seller who ships the wrong item might get One Star for Description, but Five Stars for Communication and Shipping Cost.

 

DSRs are more important to sellers than feedback.
