The seller never shipped, the expected delivery was Sept 20, 2022. Note this date Sept 20, 2022, because apparently, it needs to be past this date because they can take any "action"...
I have now contacted eBay for the 7th time via Live Chat, and every single rep has told me something different.
All i want is my refund since the seller didn't even bother with shipping out the shoes they posted.
I have started a case on my end, but now it shows..

I never got the shoes. I never contacted the seller because eBay authenticity don't allow communication between buyer and seller. SO WHY. SOMEONE HELP ME.

We can import from the USA duty free up to a value of $150Cdn and tax free up to a value of $40.
This has been the situation since July 1, 2020.
More to the point, did you open an Item Not Received dispute on Sept. 21?
You have 30 days to do so.
This is totally automated and usually very efficient
If the seller cannot prove delivery, you should be refunded.
BUT - I'm not sure, but "delivery" may mean delivery to the Authentication Centre, after which the responsibility for delivery may move to the Centre.
I'm basing this on the policy for the Global Shipping Program, which is a Seller Protection program.
But if you asked that the seller lie about the value of your purchase on the customs form, which is illegal for both of you, I hope you were wearing old sneakers, because you shawt yourself in the foot.

Unless there was a problem at customs that info is confusing. To clarify, this was the result of an item not received claim? Did you send a message to the seller about customs when you paid? Even if you did, if the item was never mailed that
doesn't give the seller the righ5 to keep your money.
Was there ever a tracking number uploaded? If so, what did it show?
If I were you I would appeal by sending a message to eBay customer service on Facebook or Twitter. In the private message give them your name, eBay ID and information about the transaction. They are usually fairly good at handling situations like this.
