"Failing an agreement between the Crown corporation and CUPW, MacPherson will have the authority to impose a settlement through binding arbitration.
"The union’s lawyer said the back-to-work legislation was passed after Canada Post created a 'false emergency' over a backlog of parcels at the Crown corporation’s sorting plants."
False emergency.
Reluctantly.

The Postal union disputes the backlog indicated by Canada Post.
Maybe they should send parcels in the mail.... incognito, and NOT identified as CUPW mail.
A start would be about 24 parcels to many different destinations in Canada, and then mailed back... returned.....
Members of the postal union are taking care of the backlog..... They should be able to verify what Canada Post has been saying.

CUPW cannot win the case.... Because they are still negotiating
and eventually everything will be settled as if the period of negotiation after November 27 was "normal"..... as if the rotating strike never occurred.
My view of the current situation.
and what would happen if CUPW was responsible for everything that happened after November 27...... The actions that were like strikes in many cities....

It could get interesting to sue CUPW to have them recognize the effect they had on online sellers.
Applying a dollar value for this effect ... suing for the loss in revenue is most likely not possible.
However, if CUPW Is forced to understand the effect on online sellers that could help with their understanding of the importance of Canada Post to online sellers.
Canada Post receives money from those online sellers that then pays the salary of postal workers.
It is the internet that has resulted in a major reduction in the flow of lettermail through Canada Post. Parcel mail has contributed to the revenue total for Canada Post, and may eventually become the major source of income for Canada Post.
CUPW must recognize that the use of Canada Post by online sellers was affected dramatically by the strike, and that resulted in the availability of less money to pay the salary of postal workers.

CUPW has the right to negotiate a new collective agreement.
BUT ..............
Does CUPW have the right to interfere with the business of online sellers?
The best answer for everything is for Canada Post to become an essential service... by an order of the Government of Canada.
...... and then no more postal disruption.... No more of an effect on Canadians whether they use lettermail or create the parcels that Canada Post must deliver ..... without ..... any measure of disruption.

CUPW is doing what it wants to do. This union lives in a room full of mirrors and the only people they see are the members of the union.
This union must wake up to the reality of what they did to online sellers.... and also online buyers.
The Government of Canada must respond to the Union's actions....
We must continue to keep track of what is, or more specifically what is not happening in an acceptable manner at Canada Post. All problems with Canada Post must continue to be documented.
This court case will most likely be addressed more intensively in 2019.... after Christmas.
