Today, I recieved my pokemon emerald from a seller. I have confirmed its a fake but the seller does not accept an returns. The item was http://www.ebay.ca/itm/Pokemon-Emerald-All-Work-And-Save-/291263077610 and it has the PayPal buyer protection system. I paid with master card with a PayPal account. Is there anything I can do to get my money back?

Absolutely. Please rest assured that regardless of whether the seller accepts returns, paypal has you covered. You need to open an Item Not As Described case as soon as possible, citing your assertion that it is counterfeit, and follow the instructions given to you. Go to Purchase History, find your item and pick and Resolve a Problem from the drop down menu. I'm sorry that things did not work for you as you expected. Good luck in the future.

I do not know how to start a claim. When I do I get this message "Seller's return policy for this item
The seller doesn't accept returns for this item, but we encourage you to contact the seller first. If you can't reach an agreement, we're happy to help." and nothing else. How can I start a claim?

You are covered-- provided it has been less than 45 days since purchase.

No returns does not mean no refunds.

As advised go to the Resolution Centre and open an Item Not as Described dispute.

You have already contacted the seller so you can skip that step.

You will have to return the item to the seller with Confirmation of Delivery. Most Canada Post services have this, but it can be expensive if your seller is overseas.

When you can show that the item has been returned, if the seller does not refund you, Paypal will and go after him for their money.

If the seller is in the USA and used the Global Shipping Program, your part of the dispute is the same, but there are some differences on the refund end. Don't worry about that. You may or may not have to return the item.

If more than 45 days have passed, eBay and Paypal will not get involved but you can phone the customer service number on the back of the credit card you really paid with (PP is just a mediator) and ask about a chargeback. The clerk will need details on the transaction so have them handy for her to process your refund. You may or may not have to return the item.

Find your item in Purchase History and on the right-hand side there will be a drop-down menu with More Actions and within that go one choice past Return This Item to Resolve a Problem. You will need a desktop computer or smartphone-supported web browser to do this. It doesn't work from a device app. There will be a series of boxes to check before your claim is opened. Escalate your dispute as soon as possible.

Just out of curiosity, what did the seller say when you told him/her this was no good? Perhaps he/she would offer a refund and/or exchange without requiring you to open a claim.
