Claiming item vintage,used and estate. Is this legal when they sell it and relist the item weeks later in a different size?

a seller claiming an item is used and from an estate and vintage. Selling that item and weeks later selling a similar item, different size .

Just because they had an item in more than one size doesn't mean it is not vintage , used or from an estate.

They could have bought out the estate of a deceased collector.
