I just purchased an item from a seller. The item was $76.05 USD + an inflated $25 for shipping within Canada. I get the invoice and they are trying to tax me on the cost of shipping. The last time I checked, it was only companies providing the shipping service (i.e. Canada Post, UPS, etc) who could do that not a seller who charges for shipping. Who is right, me or the seller?
Thanks in advance
Kelly.

We charge GST on shipping.....
When you go to the Post Office and buy stamps or freight for goods shipped within Canada, they are subject to GST. Likewise we pass this charge on to our customers.
If you import goods into Canada, you will be charged GST and PST on the assessed value.

" they are trying to tax me on the cost of shipping"
Shipping is taxable within Canada.
However only sellers registered with the Federal government can charge GST (or HST) and must give you their GST registration number on the invoice.

Once you have registered as a seller with Revenue Canada, you must charge GST on all goods AND SERVICES. Including shipping! I don't know how many buyers have stiffed me on the GST on shipping (usually just pennies, but those pennies add up), but I have to figure it as collected and send it in with my return. PST in most province is a whole 'nother story -- only on goods, NOT services. Makes for fun bookkeeping -- NOT.
And Todd, it's not the invoice value that determines whether you must charge GST, it's your annual sales and once you've registered, as I understand it, you MUST collect until you go out of business!

"Your GST # does not have to be on envoices under 30.00 Canadian Even if you charged GST "
That is technically correct.
For transactions under $30, the Act requires
Vendor's business or trading name
Date when GST was paid (or payable)
Total amount paid or payable
For transactions between $30 and $150, the Act requires
Vendor's business or trading name
Date when GST was paid (or payable)
Total amount paid or payable
An indication of which items are subject to GST and either the total amount of GST
Vendor's GST registration number
For transactions over $150, the Act requires
Vendor's business or trading name
Date when GST was paid (or payable)
Total amount paid or payable
An indication of which items are subject to GST and either the total amount of GST
Vendor's GST registration number
Purchaser's name or trading name
Description of item
However, in practice, most registered sellers include their Registration number on all invoices, regardless of value.
