MY EBAY NIGHTMARE, A WARNING...THIS COULD HAPPEN TO YOU TOO!!

If you've read my previous posts you'll know that pretty much all the issues with ebay like the new feedback system or other various annoyances you hear about don't really bother me. As I've said in the past, overall I'm pretty thrilled with the opportunity ebay provides our company in terms of world wide sales. But something happened to me this week that has rocked my opinion of ebay.

Monday morning I received an email from ebay that an auction of mine for a Ferrari jacket had ended due to copyright violation, IE. Ferrari was claiming it was a fake. Now I have a contact at Ferrari in Italy whom I had been working with for over a year whom I would email pictures of items I found to get the ok or not ok as to whether they were legit before listing them. I hadn't been in contact with him for a few months because over time, in working with him, I had gotten to know what to look for to determine the authenticity. This is why I knew that my jacket was legit. I emailed the contact provided in the email from ebay at Ferrari with some additional pictures of the jacket, even though there were plenty in the listing itself to see clearly it was legit. During this communication I realized that my contact had moved to another department and was replaced by the guy who claimed my item was fake. After viewing my additional pictures he realized he had made a mistake and that the item was in fact legitimate. Now during this back and forth I received a second email from ebay identical to the first one. Following that came another email stating that my account had been suspended for 7 days. Once Ferrari guy realized his error he immediately notified ebay and my account was reinstated by 7pm the same day.

Ebay notified me that they had reinstated the listing for the Ferrari jacket as well, and that it was put into my ended items folder and that all I had to do was relist it. Now here's the kicker...but they deleted all my 1600 plus listings (auction and store items) and those they COULD NOT recover.

So now my store is empty (50% of my sales come from our store) and I have to redo 1600+ items from scratch, pictures and all. It's going to take me about a month of working overtime to get back on track and I no doubt will lose thousands of dollars all for something in which I was not at fault. After bitching to ebay's customer service department (if there is such a thing) I finally found one guy with a shred of compassion who actually offered some sort of apology and who reinstated a whopping 130 of my listings. My question is if they can recover 130 listings, INCLUDING the one that caused all this mess, then why can't they get all my store listings back into my ended items folder so I can simply relist? I'm completely sure they can, but obviously they just don't feel like it. I even emailed Isabel a couple of days ago explaining my situation and I haven't even got a response.

Last fall it was bothering me a little bit that we (quoting my new favourite bookseller) had too many of our eggs in one ebay basket. So in January we moved into an office which doubles as a store, open two days a week, and we've seen steady growth there. Today I am convinced I had a premonition back in the fall about what happened this week. This fiasco has only accelerated our efforts to find other ways outside of ebay to move our stuff and it is now our objective to reduce ebay to 25% of our sales channels within 2 years.

You know, I understand the need to protect the marketplace and I have no issues with the suspension...we were allowed to work it out and I was back on within hours, that's fine. But deleting all our auctions before allowing due process??? That is not only not fair, to me it borders on criminal. Those listings have to be somewhere.

The icing on the cake was later this week we received a call from the ebay seller outreach program wanting to sit down with us on the phone because we are a "top seller" and one of ebay's "most important" blah blah blah. They want to help us to take our business to the next level, meanwhile earlier in the week they took our business two steps backwards.

Bottom line we've decided we won't let ebay or anyone else for that matter take us hostage. I'm not a fool, I won't let the fact that I don't like them very much right now cloud me to the reality that I can still make money here. They use us and I for damn sure will continue to use them to line my pockets. But they've turned us into someone who wants to work less with them now. Someone's missing the boat over there.

If anyone has had any similiar experiences and actually has some ideas or tips on how I might be able to get those listings back I'd be appreciate any input.

you know...a happy ending, but its sad you have to wait so long, and send so many emails. i would DEFINITELY send that compensation email...i know you did already, and they should definitely meet your expectation on this one. i'm tired of people/businesses not taking any responsibility for their actions in this world..!

Well no response to my compensation email. Trust me I didn't ask for millions.

But this morning I got an email from support saying that they've reviewed the restriction on my account and that it's valid and that if I want to appeal it I can do so in 6 months. WTF?? What restriction? I was also warned to be very careful not to list anything that might not be authentic otherwise I might have my account suspended permanently. Sigh....

I have had a handful of auctions ended over 7 years, either honest mistakes or a rights owner pulling bs. But With each one of the bs cases I eventually gave up because no one would give me straight answers. I now realize giving up was a mistake because I guess all these "violations" are showing on my account and I am being warned even though this time I was proven innocent of any wrongdoing. It's so discouraging because I could sit down with an ebay rep and spend all day pointing out sellers who are clearly selling tons of illegal stuff, have been doing so for ages and THAT IS ALL THEY SELL. Yet I have a half dozen or so items in over 5000 transactions that were pulled either as an honest mistake or incorrectly pulled as infringing and I'm getting treated like this big bad villain.

I'm really hoping this is a clueless csr who has no idea what has transpired over the last 2 weeks and they were answering an email I sent way late after the fact. I've forwarded it to Lorenzo, Izzy and Jordan and asked if I could get some clarification.

I'm at my wits end with ebay right now. Tomorrow I have my call from ebay seller outreach, so they can "help me take my business to the next level"...how excited do you think I am about this call?? When they call I should just leave them a recorded message....

By the way I noticed in another thread there was discussion about opening another ID for buying. Well my question is...if I do have these "violations" on my account and I am hanging by a thin thread as they say, do you think it is possible/wise to start another selling ID...link them so customers know you are one and the same and slowly move my merchandise over to the new account and when the time is right, close the old one and go full time with the new one, thereby working with an ID that has a clean slate. Does this make any sense?

I'd hate to give up on that feedback I've worked my tail off to earn but if I could protect myself a little better this way, might be worth it.

I'd appreciate any input.

Turns out it was a late arriving email from a clueless csr. Still no response in regards to compensation.

Well I guess we'll have to live with our ebay business hanging by a thread and be completely vulnerable to the whims of rights owners. Nice reward for all these years of commitment to ebay, paying our fees in full on time all the time and serving our customers in A1 fashion (not to mention sticking up for ebay on these boards). Ebay has now become like our lazy landlord at our store...A necessary evil in the process of doing business.

Well finally today we received a $500 fee credit from ebay on our account for what happened. It doesn't cover the over 2 grand we estimate we lost...but at least it is something. Now I am trying to get Ferrari to send us some merchandise we can sell to help recoup a few more bucks...It's been almost a week since I emailed them with that request and no reply. I'll keep trying though as I think it is a fair request.

My conclusion on all this is that I think ebay's upper brass and department leaders do care about their sellers. The problem is that they have too many layers of employees, way too much automation and a horrendous communication system. Because of this, although they may care, they are completely out of touch with what's going on in the trenches. To me it's obvious that even though ebay is a huge company, they still have a long way to go before they become an efficient company. While the company in some areas is cutting edge, in other areas it's clear they are still learning as they go. As big as they are, this company is still just about 10 years old if you figure the first few years they were smalltime. They are an infant really in the world of big business. They've been way too lax in the past on fake items being sold and incidents of fraud on the site. Because of this they are getting sued up the wazoo. Now in their eagerness to rectify things, their heart and soul, their sellers, are getting hurt in the process.

We've done some further research and it is clear that many of the rights owners in the vero program are abusing the system and are not just using it to find fakes, but they're using it to eliminate legitimate competition as well. In fact a UK high court ruling in Nov 2006 highly criticized the vero program in general stating and I quote "it is entirely wrong for owners of intellectual rights to assert them without litigation or threat of litigation". Bottom line, it simply appears that in the ebay world you're dealing with an entirely different set of rules than in the real world.

It's been a hell of an ordeal what happened. We're trucking on but the truth is we're still feeling the affects. Oh well, just gotta roll up the sleeves and work.

I'm glad you received a settlement of sorts Marcello. From what I have seen so far on eBay I agree that the system needs a lot of work. One of the reasons that new businesses fail is not because they are not making money, but they are growing too fast to keep up with the demands on them to do the things that are required. eBay has grown very fast and hopefully they will take on the monumental task of getting things to run smoothly at all levels as fast as possible before things get out of hand.
IMO they need to start by giving the sellers more protection and rights, quit raising fees and stop biting the hands that feed them.

Holy carp. My head is spinning. I can't believe the obstacles you have had to overcome. I don't know if you have much of a legal recourse with Ferrari, but you can hope!
