Seller has not shipped my item yet

So I bought an item 5 business days ago but 7 days in total now including the weekend and of the day I bought the item money was taken out of my account. So out of those 5 business days should my payment not  have been a cleared payment in order for the seller to ship my item? Have contacted twice now and still have not heard back and it is still showing as my item is not shipped. I tried to contact ebay but none of the topics to choose to open a case are of what I need and don't always have the time to call ebay. What should I do?

Yes it is for the little house on the prarie item, and thanks for response so quick , I did just filed the case on paypal just now so will have I wait back for them now thanks.

Payments made from bank accounts and processed by Paypal may take up to 10 days to clear . If the seller is new that payment may be held for another 21 days against the seller's good performance.

However, once cleared, 21 Day Hold or no, the seller is required to ship within 7 days of clearance. He can ship your item through Paypal and PP will take the cost of shipping from the otherwise Held payment.

In other words, it is 'eBay legal" for a seller not to ship for up to 17 days after the customer has paid by e-cheque.

But check his feedback, a litany of complaints about bad shipping would mean you should file the Dispute now.

For future reference, if you use PP to process credit card payments the payment clears immediately. And you have an extra layer of protection in the card's chargeback program.

Thanks for the info will check out the feedback, that's all fine with me accept the fact of not answering two of my messages which one is 5 days ago and the other 3. To me he should of answered me to let me know this but thanks for letting me know
