Suggestion for item being returned damaged

We recently had a buyer return and item that he was unhappy with because of cosmetic reasons. When we received the returned item and opened the box the item was severely damaged rendering it unsellable and purely good for the junk pile.

This item was an very expensive car audio subwoofer, performance series worth about US$400 retail.

The buyer does not want to file and insurance claim with the shipper (FEDEX) and instead has initiated a dispute with PAYPAL and also has contacted his credit card company to file a chargeback.

We refused to offer any refund because the item is severely damaged and we feel we should not have to pay for damaged either caused by his improper packaging and/or due to damaged caused by shipper.

We have photos of the original item as when we shipped it to the buyer and also we took photos of the item when we received it back showing all the damage.

Have any of you had a similiar experience and if so how did eBay/Paypal settle the matter.

Sadly, if he files a claim with PayPal they will probably give him a refund provided he can prove return delivery.
