There is no way to get money back from seller?!

I have bought 2 new ipad cases with a seller(CHINA) for around US$30 on April 4, (Stated they are good for the new ipad).

 

After 36 days, I got my cases, and they are not good for the new ipad (new ipad can't be fit into the cases). Then I contacted the seller, and the seller asked me to mail them back to CHINA and he will reimburse me with the shipping cost(which is around CAN$10), then he will resend two new cases.

 

The seller seems very nice and very responsive at first, so after I mailed back the cases, I also emailed the postal receipt as instructed, and he said he will do a refund after he got the cases back.

 

After another month or so, I emailed the seller saying that I haven’tr receive anything from him, and he responsed nicely, and asked me to wait for another week or so because of the postal service in CHINA. So I waited and waited. After about 2 weeks or so, I asked him if he received the cases I sent back. He then started to ignore all my emails.

 

So now, After 3 months, I paid US$30 for the cases and CAN$10 for shipping back the cases, and I got absolutly nothing in return. And EBAY couldn’t help me with anything!!!because it’s over 45 days....WHAT A JOKE!

A seller in China, huh?  Unfortunately, there is so much emphasis to bid & buy, yet we do not have links to ebay refund policy dangled at us with the same enthusiasm.  It's too late now, but Section 4 here would have been a good one:

If you used a credit card, you can try for a chargeback by calling the 1-800 number on the back of the card.  Have all the transaction details on hand when you do.  If this is an option for you, do it right now as there are deadlines for this too, longer or shorter depending on your card.

It will not come as much comfort, but yours is a common tale.  The sweetest sincerity, so earnest the promises, until you can no longer do anything about it, - and then your seller vanishes in a whoosh.  Your savvy seller managed to delay you past the 45 day refund deadline, as well as the 60 day feedback deadline.  Sadly.

Unfortunately you ran into a scammer who deliberately strung you along until the dispute deadline had expired. Your only hope for a refund is the chargeback mentioned by dmil. The next time there is a delay in receiving,make sure to open an item not received dispute by day 43 at the latest,no matter what the seller is telling you. You can always return there fund to the seller if the item ever arrives. Unfortunately in cases like yours there never was an item.,nothing was ever shipped.
