You should not be talking to the seller about this, however.

This will speed up your refund. That refund would include the import fees you paid.
I suspect that there might be an in depth investigation of the missing phone, since it could be a cheating seller, damage in the mailstream, or theft at the plant. But that does not concern you.
Let your seller's feedback - given and received - guide you about buying another phone from him once you get your refund.
