I've been badly scammed

In March, I bought an "adult product" from a seller, who had mostly high good reviews. They even offered a 2 month (60 day) warranty on this item at the time. Well, after owning it for 2 weeks, the silicone melted to a point it was unusable in my closet. I stored it according to description and everything, being cool and dry in my closet.

I was unable to create a eBay dispute because it had passed the time, because the item shipped from China and I had been left with a very small window to dispute it. So I contacted the seller. They asked for images, so I sent them. They then told me I do not need to ship the item back because they understand it takes time and more than what it was worth. They also stated that they would send a replacement "of better quality" to replace this item, despite me asking for my money back.

The end of June came around, and I still have not recieved the replacement. I contacted the seller again, and they lied about being able to see tracking information when there was none. So I opened a PayPal dispute. PayPal didn't close in my favor because they ignored the proof I sent about the seller telling me that I did not need to return the item, and that a false warranty had been posted on the ad.

Now it is august. The seller refuses to respond to my messages, I have been scammed by being sent poor quality trash, and they ran with my money. And I still never recieved any replacement item. The seller has also changed the description of their item to state 1 month, meaning that no matter what I do I cannot fight it because the information is now different.

I don't know what to do about this. I've called eBay about it, who in their rules states that false warranty information is against the rules. But they will not do anything about it. I've been given the run around for 5 months now because of lies and this fake warranty. I cannot even report the item for having fake warranty information. So how the heck do I get my money back at this point?

Most warranties are from the manufacturer not the seller  (although the seller may handle details).  Online warranties are worth the paper they are written on.

 

You had 30 days from delivery to open an eBay dispute for Not As Described. That time has passed.

 

 

You have 180 days from PAYMENT to open a dispute on Paypal for Not As Described.

Days- and to the second.

The PP Resolution Centre is on most PP account pages at the top under Tools.

Open it NOW.

The first suggestion is to contact the seller. You've done that to no avail.

Move on to asking PP to step in and Escalate to a Claim.'

Bad news.

PP requires you to return the item to the seller with tracking.

International tracking is expensive.

Only when you can show the item has been returned (delivery not shipping) you will be refunded.

 

Time is short.

 

You can also call the 1-800 number on the back of the credit card you use to back your PP account and ask about a chargeback.

Do this is the PP dispute is not accepted due to timing.

Card policies differ but expect to need dates, transaction numbers, payment amounts, currency etc. Some cards require return of goods, some don't.

i agree 100% with femmefan1946, you need to file a chargeback through your credit card company.
