I bought a phone that was damaged during shipping and wanted to send it back to seller and get a refund, the seller said to contact canada post and ask for a refund, but canada post does not allow refunds to receivers only to senders. So seller does not want to give a refund and is getting paid twice for a now useless phone. customer service apparently sided with seller and refused to give a me refund also. Am I missing something here, cause this doesn't seem fair for the buyer.

You said that customer service sided with the seller...did you open a return case? If so, what reason did you give for the return? When did you receive the item?

Did you open a Dispute in the Resolution Centre?
Normally this automated* service will tell the seller to send you Return Shipping with tracking**.
Once tracking shows that the phone is back with the seller, you would be refunded.
Which parts of this did you miss?
You are right, only the seller can claim on Canada Post insurance.
If you are past the deadline for a Dispute (30 days from delivery), you can still make a claim through Paypal.
The PP Resolution Centre is at the top of your account page under Tools.
You have 180 days from Payment to make a PP claim.
Unfortunately PP requires the buyer to return the unwanted item to the seller, again with tracking. But when that shows the return, you will be refunded.
You are also covered by the chargeback provisions of your credit card that you back your PP account with. Card policies differ.
* You do NOT need or want a live person.
** If the value of the phone, including original shipping, is over $650 you will also need Signature Confirmation.

did a return case for damaged product when description said was 9 out of 10 condtion, seller showed proof the item was shipped in described condition so the fault was on canada post.

That doesn't make sense so perhaps we are missing some information. It is the seller's responsibility to make sure that the item arrives in the condition that it was described in. Even if it was Canada Post's fault, the seller is still responsible for accepting the return, refunding you and then they can make a claim with the post office.
You did open a return claim within 30 days after delivery? Did the seller refuse the return and the case was closed?
Is it possible to post a screen shot of the return claim and the response from customer service? You can block any personal information? We would like to help you but I think that we are missing some information.

I made the claim the day it arrived, yes seller refused any refund and said i'll get a refund from canada post and basically went quit after that. and the case was closed after the seller contacted customer service to force a final descision.

It's up to sellers judgement if they would like the item returned to them or not. It's not always cost effective. As for claims those need to be initiated by the shipper.See attached with CP & USPS procedures. The cooperation of the receiver will be required once that has happened. Important to save all packaging material and have an explanation available for how the item arrived in your hands. Only after the claim has been processed will a decision be made for the shipper to be compensated(or not). Because the item arrived damaged the shipper would be responsible to refund you for the damaged item as per eBay requirements.

I'd go for the Paypal Resolution Centre, although you will be paying for return shipping.
When you get your refund, you can leave feedback. You have 60 days from payment for that. Take your time.
The most effective feedback is calm and factual.

Well...it still doesn't make sense to me as when I buyer files a return saying that the item was not as described they do not have an option of refusing to refund. They have 2 options...accept the return or refund without asking for a return. Anyway, if you paid through Paypal you can file a claim there or if you used a credit card, you could also do a chargeback.

Before you open a claim somewhere else, you could also contact customer service to appeal their decision by sending a private message through ebay Facebook or Twitter.

The odds of a seller winning a case with eBay seem to be few and far between as of late. Filing a claim for valid damaged in transit or lost on the way/Chicago Black Holes with the post office are 2 of the few protections sellers still have. How long before delivery guarantees are back?

Hi guys,
My apeal went through and a actual person saw the messages between me and the seller and issued a refund and I don't have to send back the worthless phone. Still doesn't seem fair the seller gets paid twice from me and canada post. I don't know if ebay will charge the seller or not. Thanks for the tips y'all cheers.

Unless the customer service rep issued a "courtesy refund," that money is going to come from the seller.
Also, a damage claim made to Canada Post is not a slam-dunk for the person filing the claim. There's a very good chance that Canada Post will rule that the item was inadequately packaged and deny the claim.
