i need a clarification. is the 45 day limit to file a claim starting from when the purchase is made or starting from when the payment is made?

He can file a claim with PayPal up to 45 days from the date the echeck cleared.

Sorry for the confusion, but i am not filing a claim. I have a problematic buyer

 

He purchased an item back in october, but his (third!) echeck didn't clear until a month later. Now he is saying he hasn't received the item. I was just wondering if he can file a claim or not

For the record, two different sets of deadline:

 

Buyers must file a claim within 45 days of payment (than means 44 days or less) in case of non receipt or goods not as described

 

That being said, we have seen a few examples of exceptions where PayPal allowed buyers to file after 45 days in some special circumstances for overseas transaction.

 

Buyers can take up to 60 days from purchase to leave feedback.

Ok, so as it turns out, I personally know of other sellers who have sold to the same buyer, and the buyer has a habit of claiming item not received and asking for refunds. I highly suspect this buyer is abusing the system. I called ebay and reported this guy, and ebay said they will investigate.

 

Does anybody know how ebay handles these situations? Do I even have a chance if the buyer decides to open a case against me?

 

I originally planned on refunding him, but no way will I refund him now. This is not even about feedback or DSR,. This is a matter of principle

Unfortunately, that is not your decision to make in most instances. 

 

If the buyer files and escalates a claim with PayPal for non-receipt within the required timeframe, PayPal will immediately take the money out of your account and ask you to prove (through tracking) that you have sent the item to the buyer.  Unless you can provide online evidence satisfactory to PayPal, that money (original transaction value including shipping) already removed from your account will be given to the buyer.

Thanks pierre, yes I realize paypal works that way. I just refuse to refund him on my own behalf. If it comes to that, so be it. If the buyer opens a claim, at least I have a chance to tell my side of the story and there will be a record of the dispute.

 

If all sellers instantly refunds buyers like these, I fear that this will just encourage this type of abuse. If a buyer has to manually open and escalate a claim everytime, perhaps he will stop or at least reduce INR claims since all claims will be on record
