I just received this email and I'm just wondering what I should do about it. Is he breaking any ebay rules? Which ones?






I just received this item and I have to say that I am rather unhappy about it. It did not come in a Swatch Skin box (I own other Swatch Skins and am aware of their packaging) and the watch also appears to have possibly been a display model or something of that nature as the watch band is dinged up and has numerous scratches all over it. The face of the watch still has it's plactic cover and is in fine condition, but this watch has clearly been handled by mutiple people over a long period of time.

I would be willing to compromise on this deal as the watch is no longer made by Swatch and rather difficult to locate. Paying full price for it though is not an option. I will accept a $25 refund and leave positive feedback or I will send it back to you for a full refund and leave negative feedback.

Please explain to me how this listing ended up like this. I have a 100% positive feedback rating on ebay and have never had a negative experience with a seller.







I have offered him full refund + shipping costs and still waiting to hear from the guy.

eBay does have a Feedback Extortion policy:

Whether your particular situation applies or not will be up to the particular eBay rep who gets your report.

Your response, in my opinion, was 100% correct. I handle similar complaints in the same way. I've had 3 "quality" complaints in the past 6 or 7 months where the buyers requested a partial refund. I instead offered an apology and a full refund upon return of the items. -- I never heard from either of them again. Based on the details they gave, and knowing the quality of the items in question, I suspected the buyers were just trying to receive a post-sale discount while still keeping the items. The offer of the full refund seems to make these buyers back off.

Are other sellers here finding an increase in buyers looking for partial refunds?

Oh yes, yes, yes. I had one just last weekend who received his item and then emailed me threatening to report for some sort of Ebay violation unless I gave him a partial refund immediately. I knew I had done nothing wrong and their was nothing wrong with the product so I wasn't particularly sweating it. I've had three or four of these in the last two months. It seems to be going hand in hand with the slow/non-paying bidders.

The other trend I am seeing, which is annoying to me but might not bother other sellers, is the increase in the use of Paypal echeques with their incredibly long wait time. In almost everycase it is relatively new Ebay/Paypal users issuing them. In two recent cases, after I waited 8 days for the cheque to clear, it "failed". Yes, that's right, more non-paying bidders.

Just one bad customer can wash away the sweet taste of 25 excellent ones. Sigh....tomorrow is another day!

Good luck policing that. Who cares, take the neg, reply to it in your profile, and neg him back too so he can stop claiming 100% to extort other sellers. It'll hurt him more than you.

Oh, I don't care about the neg at all. But i'm afraid this is the type of guy who will file a drawback on his CC and I'll lose money...



Still waiting for his response though.



And the response from ebay is: "[...] and at this point find that we do not have enough evidence to show that the member has violated any eBay rules at this time."

Actually it's been a week now and nothing has happened... no reply from the guy or anything.

Pondering if I should leave a neg about this or a neutral?

The reason why I think about leaving a negative is to warn other people about this jackaaa. The purpose of the feedback system, right?

IT is not proper to use feedback as a tool, and the buyer in this case is clearly threatening feedback to get what he wants!!. this is against ebay policy.

As far as partial refunds are concerned this is a legit concern I think sometimes. I had asked for a partial refund at one time. The item i bought was 44.00 US and it cost me 15.00 to ship. It would have cost me another 20.00 to return which means I would be out 35.00 on a 44.00 item if I returned it!! (or more if the seller never returned my money).

The two items i bought were useless, but with parts from one item , i could made the other one good as new. So rather than return, I explained to the seller the issues and asked that i recieve a half refund as I only recieved one good item!!.

The seller after 2 emails finally said to give me my address again and he would issue a half refund!!!. I never heard from him again. I left a negetive feedback later with no response from the seller to retaliate.
