Paypal did not help and closed the resolution.
I bought on May 22nd.
Checked with Tim Horton's because wanted to use for the Father's Day deal and they said that the gift Cards have been closed.
Paypal said they don't cover Gift Cards.
So why is Ebay allowing selling of Gift Cards on Ebay if they don't protect the Buyers???
What can I do? I lost $160.....

Why would eBay have a "gift cards" classification if selling gift cards wasn't allowed on the site?

What do you mean by "selling a gift card from stolen credit cards"?
What do you mean by Tim Hortons saying "the gift cards have been closed"?

Seller sold a pile of tim hortons gift cards. TIm hortons told op they were paid for fraudulently and they canceled them. Paypal policy is that cash equivalents aren't covered by buyer protection so op out of luck
The weird thing is, the seller here sold a highly unusual amount to have in Tim Hortons and subway gift cards ($1000s) a number of buyers. But the many other buyers who have left fb have all left positives
op did you call your seller? its the only avenue you have

My jaw dropped when I heard this from Paypal and Ebay...
Why would they have a category on Ebay and not protect the buyers? Ebay, paypal are not small chumps anymore, they are as big as credit card companies, if they can't cover me then who can... it really is sad. I had to learn the hard way that Gift Cards aren't protected by Ebay and Paypal...
I would have really apprecated a FLASHING SCREEN when I went to pay for a Gift Card on Ebay saying YOU ARE NOT COVERED BYE AT YOUR OWN RISK!!!!
I am just wondering if I can file a police case against this fellow... Paypal is going to protect this #@$%@ because that is their policy and only a Subpoena from the police will allow them to release this guys info.
Mind you, I am going about all of this info from Tim Horton's leg work on the Gift Card and they stated these are bought from Stolen Gift Cards and I trust Tim Horton's more than this.
The people that are buying from his are probably using these up really quickly and not loosing out or either are leaving a feedback too quickly and will get a surprise soon...
Eitherway, Ebay and Paypal have really let me down.... Because of the powerless position they are in... I got duped, and I was hoping that Ebay and Paypal didn't but apparently they also got duped by this seller....

I am really surprised, this seller just listed gift cards for Subway!!!..
After spending hours with Paypal and Ebay, they haven't shut this seller down!!!

From what you've said, there's no clear-cut evidence that the seller was the person who purchased the gift card fraudulently in the first place. Keep in mind the possibility that he may have bought it from someone else.
If you want to direct your energies constructively, why not ask eBay why they display the "Pay with PayPal and your purchase is protected" message on gift card listings?

You are a clear advocate for this Seller.
You have to realize, I did not start ringing the bells and whistles without cause.
A few things led me to this....
No reply from Seller via Ebay messaging. Ebay sent me his private phone number and I called him through a US number directly.
Secondly, It is logical to assume that there may be something odd with this seller because, this is not a one time thing where he is selling his Grandma's Gift... He is methodically selling gift cards of high value on a regular basis with good discounts. That is ODD, maybe not wrong, but ODD.
Then to have Tim Horton's tell me that these are fraudulent, Ebay and Paypal went and hid in a whole refusing to help and no reply from the seller had me criticize anyone and everyone that I could.
If you look at my previous post, I am pissed at Ebay and Paypal equally.
And, thank you, I will look into this BS of a comment that Ebay is putting on these Gift Card Listings...

Agree there is something very odd about having that large quantity and selling them here. And with the fees now it doesnt make any sense to sell them here. Anyone with that quantity is going to be aware of the gift card site that will directly pay 80%+ of face for ones like that with with no risk.

I don't disagree that your story of your seller is an odd one (and a bit oddly worded--thanks for the translation, Tobyshitzu) and how he's going about selling is indeed strange, but what you've said doesn't provide needed evidence that the seller has obtained his merchandise through wrong-doing on his part.
So far, you're the only buyer who's left this seller negative feedback for selling invalid gift cards. At this point, I don't think eBay has much--if anything--to go on when it comes to taking action against this seller.
I am glad you plan on taking the whole "protection" issue up with eBay, though. Even the terms and conditions page linked on the listing page says nothing about "cash equivalent" sales being ineligible for protection.

Since eBay and Paypal have told you they will not cover you under their Buyer Protection Programs
If the seller does not follow through on his promise of a refund.
Go to the credit card you actually used to pay for the cards (Paypal is just a useful mediator) phone the 1-800 customer service number and ask about a chargeback.
Whether he follows through on the refund or not.
You can leave FB for 60 days after purchase. The most effective FB is calm and factual.
At the same time you can leave Detailed Seller Ratings. A normal transaction gets Five Stars. The lowest Rating is ONE STAR.. No stars are a free pass.
You can add a Response to your own or your seller's feedback indefinitely. Again the most effective Responses aer calm and factual.
