Got ripped off by a US powersellers.

Purchased couple shoes advertised as "worn once" by the seller, when received they are actually well worn on one and the other one is a wrong size.

Seller charged $34 for shipping but actual fee was only $17.

Seller send back a form letter saying she'll refund price on merchandise only if return within 3 days with a tracking #, which means i'll be out $17 (shipping back) plus the $34 she charged me on the 1st place = $51 for absolutely nothing.

Ebay suggested i called the seller which i did and found out she was using her dad's (86 years old) name and account and he hasn't talked to her in a long time. Paypal has useless protection for fake or wrong merchandise. Both ebay and paypal offer no concrete helps.

Seller will leave negative feedback if you dare to leave her one, it seems it has happened to a few people already.

She knows exactly what's happening and it seems she has the perfect formula to rip off more people.

Any suggestions?

well the first pair look nearly next to new! although the second pair, if you look close enough, you can see the 'worn' part...her listing says no returns..i guess she's allowing an exception for you? she certainly has alot of conditions...isn't there something about using someone else's information as your own?? i'm no pro, but i would suspect that would be an issue you can look into? i'm sure someone else here that knows better will advise...

what real lookin' dishonest seller...it appears she's real retaliatory! if the same number of people are having the same problem...wake up girly..fix it instead of leaving negetives to those who left neutrals for a recurring problem on your part. you're almost guaranteed a negetive from this one if you decide to leave one for her...good luck..thank goodness it wasn't TONS of money...

File an Item Not as Described with PayPal. You will have to ship the shoes back, WITH TRACKING, but PayPal will refund you the entire amount including shipping charges. That way you are only out the $ it cost to ship it back.

DO NOT FORGET ABOUT THE TRACKING WITH SIGNATURE, PayPal will require a tracking number and POD before they issue your refund.

Plus if you make a real stink about it, PayPal reps are allowed to give up some credit on the top. But you have to push hard and they may have changed the policy since a year ago.

Looking at her feedback percentage she is approaching the 5% mark so all it will take is a few more negatives to push her over and eBaY Trust & Safety will do the rest.

Escalated to claim and paypal supposed to make a decision by Thursday (dec 13), still nothing by today (friday); called them again and the agent said this time it was only an estimate and he'll email them for an update.

Finally, received an email from paypal that simply said:


"We have concluded our investigation into this case. Unfortunately, at this time we are unable to decide this claim in your favor."

So despite the incorrect seller info, wrongly advertised content plus incorrect size sent, and after numerous phone calls and email to paypal and ebay, i still get RIPPED OFF BY THIS US POWER SELLER & WAS NOT PROTECTED BY THE PAYPAL SYSTEM!

Did you return the shoes? If you want the "system" to protect you then you have to work within the system and that means returning the goods.

i would also need to know if they'll refund my cost 100%, the shoes cost $25, shipping to me cost $34; if i am going to spend $15 to ship it back, i'd need to get my whole $59 back; otherwise i'll end up with $25 less $15 = $10!

When PayPal approves a SNAD claim they buyer gets a complete refund (not included the costs to return the item).

the problem is they never approved it, that's why i said i'd need an approval before returning the items.

i don't think they'd refund me if i just returned the items.

To my knowledge that's what you're supposed to do. I was under the impression that they would approve the claim after you shipped it with tracking and said tracking shows receipt to the seller.

They don't give you the money and then you return the item. You have to return the item first, with tracking. I always thought approving the claim meant funds reimbursal. Doesn't it or does it mean something else?

PayPal's system is automated, even though they give you the impression that you are being taken care of by a "dispute specialist". In order to receive your refund you would have had to return the shoes with tracking. Once PayPal confirmed the delivery from your tracking they would have refunded you your full, initial payment. By not returning the shoes with tracking you forfeited your case.

"PayPal's system is automated" that's not what they told me over the phones, i have called them a few times.

My past expereience is that they'd send you an email requesting that you provide them with a tracking # for shipping it back; which i have not received this time.

How in the hell would you know if they don't tell you? i don't think anyone can just send back the stuff they don't want and get full reimbursement.

In the dispute panel, it stated that there's nothing more you should or can be, as the case is under review.

I mis-stated that. PayPal's dispute process includes the "review" by a real, live human being. The results, however, follow a standard procedure. If the customer returns the item with tracking they get their original amount back in full.
