Got ripped off by a US powersellers.

Purchased couple shoes advertised as "worn once" by the seller, when received they are actually well worn on one and the other one is a wrong size.

Seller charged $34 for shipping but actual fee was only $17.

Seller send back a form letter saying she'll refund price on merchandise only if return within 3 days with a tracking #, which means i'll be out $17 (shipping back) plus the $34 she charged me on the 1st place = $51 for absolutely nothing.

Ebay suggested i called the seller which i did and found out she was using her dad's (86 years old) name and account and he hasn't talked to her in a long time. Paypal has useless protection for fake or wrong merchandise. Both ebay and paypal offer no concrete helps.

Seller will leave negative feedback if you dare to leave her one, it seems it has happened to a few people already.

She knows exactly what's happening and it seems she has the perfect formula to rip off more people.

Any suggestions?

there was no interaction with a live human whatsoever from paypal with regard to this case.

i called paypal again and was told i should not return the item unless instructed by paypal after the case is opened.

Yes Ugly and cost me $59, not to mention lot of hassles.

With experience like these, i can see why people stop buying on ebay 😞

It's too late now, but you think paypal will accept the same tracking number that the buyer used to send to me?

I am now appealing the case and paypal said on the phone it'll get settle in couple days but it's been over 7 days now and all it says is "under review by paypal", pretty much like it was for 1.5 months when i escalated the original claim.

I think your getting very good advice here by almost everyone. Return the shoes and request your refund...in full. you can't have it both ways, it has to be done in that order. Also, nobody mentioned your credit card co.?
You can get a charge-back for your purchase the same as any other buyer. Payment thru Paypal is through your credit card. You may also better complain to your credit card co. with the # on the back of your cc card.
It doesn't really matter what restrictions she put in the listing, even 'as is' or 'all sales final'...whatever.
The fact is that even with these legal quotes there is still another better one in your favor under the 'Fair Trades Act' called "IMPLIED WARRANTY". Al;so reconized in almost all states as well as CA.
So, do what you will, but I have to fully agree, Send the shoes back.

Yes absolutely, thank you all for your valuable advice!

It's just that when i talk to paypal on the phone they said do not send it back until i was told to, but at the same time my file just sit there and they are not asking for evidence or anything.

May be i'll spend another $15 to send it back with a trakcking # and signature and take my chance.

My appeal has been turned down 😞 after months of waiting. They did not ask for any evidence nor any approval letting me to send the stuff back.

Like i said in the beginning, paypal provides absolutely no protection, for sellers who knows the tricks, you CAN BE RIPPED OFF easily!

Small wonder many buyers are turned off buying on ebay.

Did you pay by credit card ? You can maybe make a claim with your credit card and indicate item never received/or not as advertised.

Everyone should pay with the credit cards in the future, despite the conversion cost.

From all the story I read on Ebay from buyers getting ripped off and Paypal not honoring BUYER PROTECTION. Its probably better using a credit card when paying with Paypal. Sorry this happened to you.

I guess this is why we are now paying for all these deadbeat sellers on Ebay taking advantage of feedback and loops.
