First go to the listing and use Contact Seller.
Politely explain the problem and ask to return the item for a full refund.
If the seller agrees, return the item with Confirmation of Delivery (the confirmation is very important).
If the seller refuses, go to the Resolution Centre at the bottom of this page and open a Dispute.
You will have filled the first step (contacting the seller) so go on to the next.
You will be instructed to return the item to the seller with Confirmation of Delivery.
When eBay can see that the item is back with the seller, you will be refunded in full.
There are a few quirks.
Deadlines- how long has it been since the purchase? You may have to go to Paypal for the return/refund if too long has passed since purchase.
Did you use Paypal to purchase?
Was the seller shipping through the Global Shipping Program?
If any of these is the case, come back and get more information.

The resolution depends on the method of shipment. If you purchased from the USA through Global Shipping Program (GSP) it is a long complicated process.
How much is the item worth?

First contact your seller and ask to return the item for a refund. Tell him the reason for the return.
He may agree or even accept a photo of a damaged item.
Problem solved.
If he is not willing to cooperate, go to the Resolution Centre at the bottom of this page.
The seller may be told to send you a return shipping label. If he is not in Canada, this is impossible, and eBay does not understand that.
So.
Keep it polite because to get your refund you will need to return the item with Confirmation of Delivery.
If he is not in Canada, this will mean paying for the return yourself and trusting that he will repay the return shipping.
EBay cannot force this, although they can force the seller to refund the original payment once you prove delivery (not shipping,delivery).
