How in the world can a seller open an unpaid item case...without sending an invoice FIRST.

I'll tell you why - because eBay in all its wisdom has yet (after how many years???), thought to code in that a seller *must* first send an invoice, and do so through the eBay messaging system.
Okay - this isn't so much a question, more of a rant as although this is now resolved, I had to pull #$%!! teeth out of an asinine seller *and* waste untold time and effort getting no where with eBay CS.
eBay...get your &%$!##!! ducks in order okay? This is business 101 and you and this idiotic seller have *really* burnt my thrusters with this stunt.
Rant over - I do hope someone at eBay can and will read this *and* act upon it other than "we are sorry for any inconvenience this may have caused you". .

I'm not sure I understand what your problem is/was.
Were you trying to file an unpaid item dispute but ebay said you had to send the invoice first? I didn't know you had to but why is it a big deal? How hard it is to send an invoice? Did you try to file the dispute before the 4 day mark?

Without knowing what transpired between you and the buyer and ebay, it is possible your ducks weren't in order.
