I bought Nokia n95 phone. It is stuck at Miami from 16 July. Please tell how I can get my money back, In case I didn't get my phone

I highly doubt your item is stuck in Miami. You are watching the tracking number the seller provided, which is not really a tracking number at all. It might be a Delivery Confirmation number, however. If this is for the N95 *GB black one, it was sent First Class International and that means cheap-o snail mail.
Your phone is on its way, that is why you see it was processed on July 16. That is just over 2 weeks, and I find many items from the US take 3 or more weeks to arrive, especially if getting reviewed by Canada Customs. If it is stuck anywhere, that is where it will be.
Many times we click on that "tracking number" and all it says is that the item is expected at a certain post office. It sounds like the seller hasn't mailed it yet. Just when we're getting really fed-up, the item arrives at our door. In my opinion we would all be better off without those numbers because unless it is an actual tracking number, it makes us more upset, not less.
That is, until we know enough to not take them seriously.
Anyway, if after about 4 weeks you do not have your phone, contact the seller and explain your concerns. You have 45 days from when you paid to file an Item Not Received claim, so that's just over 6 weeks. Lots of time. And just so you know, you might have to pay tax (according to your province) on the phone when it arrives, plus $8.50 to Canada Post for processing.
