I puchased an item on May 10th ($235), recieved notification that it was shipped & then an email saying that they were out of stock. I have communicated back & forth with the seller (who has a good rating) but am unable to get a clear answer on when they will have the item to ship to me. They have offered to refund my payment if I want. However, I feel that they may have incorrectly listed the item with free shipping (approx.$150) and are wanting me to give up on the deal so that they do not have to ship for free. There are other listings for this item on eBay, and all have shipping as an additional/separate charge. I may just cancel this transaction & purchase from another seller. I would then leave a negative feedback for the 1st seller, but I am unsure if my suspicions about the deal are correct, which would affect the severity of my feedback.

Is the seller being dishonest here to avoid paying the shipping? Should the item been listed when they had none in stock? (does this go against eBay policy)

Hi jnie.. questions you raise are of no importance at this point.  Facts are, you do not have your item and fast approaching the deadline for filing a claim.

 

What you should do immediately is go to the resolution center in your PayPal account and open an item not received dispute. Escalate the dispute to a claim and cease communication with the seller. PP will refund payment.

You are indeed being strung along.Your seller is hoping to delay you long enough that the 45 day time limit for opening an item not received dispute expires. Whether or not the seller listing an out of stock item is against eBay policy(it is) is not important right now.Your seller is not going to ship your item and you need to get a refund before the dispute deadline expires. Open an item not received dispute through PayPal immediately.State that you never received the item you ordered.Escalate to a claim as soon as paypal allows.If PayPal decides in your favour,you will receive a full refund,including shipping. If the item arrives while the dispute is open,you can close the dispute. If the refund arrives after the item arrives,you can return the refund to the seller. Close the dispute for no reason other than receipt of the item as once closed for any reason,a dispute cannot be re-opened. You have 60 days to leave feedback and DSRs for this transaction.make sure to leave the feedback you feel the seller deserves.

Thanks for your input on this matter. I was asking for some advice on this as I knew the deadline for opening a dispute or claim was approaching soon. I did, in fact, request a refund from the seller of the item that was not shipped. After requesting this, I did as suggested & opened a dispute via Paypal - for good measure. The seller did refund the purchase price & Paypal expedited the process.

Thanks again for you input & all has ended as good as it can.
