I've sold an item that has been shipped on Nov 8th to Hawaii by regular airmail without tracking. On Jan 3rd, the buyer contact me to say that he didn't received the item and if I don't reply he will contact Ebay the next day. (I don't undertand why he didn't contact me before within the 45 days if he didn't get the item).
After I made a reply to his message, he sent me back a message stating that he has been moved to a new place and he gave me his new address.
But, the address that he provided for the transaction on PayPal transaction detail page is another address. So, I told him that the address was different than the one that you have provided.
Then, he replied me saying that he is wasting his time and he will forward the messages to Ebay to see how not compliant I am.
I didn't ask the buyer when did he moved, I think this is too personal to ask. I explained to the buyer that it's an international shipment from Canada to Hawaii, which is a remote area, to it might take up to 20-30 business days to reach sometime. I told him that the item didn't send back to me, so I guess it might be hold in the buyer's local post office if the item was delivered during his move.
And he keep saying that he did not received the item and he will contact Ebay because I am not compliant, etc.
But, this transaction was more than 45 days, which means that the buyer's protection is expired. So, what can happen to me??

nothing but a negative feedback which there chance to do that will expire in 4 days with the info you provided..
this is there fault not yours and he will get no where with ebay specially if they forward a message with him stating he moved and that the address that he had on his paypal account was not where they live anymore..
i would say because they don't know the system they are not trying to rip you off buttttttttt what is happening is their fault not yours..

Not quite.
There are several types of "protections" involved in an eBay transaction.
From the buyer's side:
- PayPal offers 45 day protection from time of payment for cases of non-receipt or goods not as described
- If 45 days have passed, buyers are also protected by their credit card issuer if payment was made through PayPal using a credit card. Typically 60/90 days, more for overseas transactions.
From the seller's side:
- PayPal offers a conditional "seller protection"
- sellers may also protect themselves purchasing insurance from the carrier (Canada Post for example) against loss or damages. Insurance can also be purchased from third parties.

Your goal at this point to is avoid receiving a negative feedback. You need to stall until 60 days have passed.
I suggest you contact the buyer, confirm once again that the purchase was mailed to (address) on (date) and agree with him that he should contact eBay to see if they can help him find the parcel sent to an old address, as provided in the PayPal payment.

Since the buyer apparently moved, ask him if he purchased a Change of Address service from USPS. Tell him that while these cause some delay, that the PO is very good about getting his mail to him eventually.
Putting the onus back on him, eh?
You could also tell him to go to his local PO today and start a Change of Address service, which might save him stress in future, whether it helps with this transaction or not.
Since you were shipping to the US, whether you used Small Packet Surface (bad idea to Hawai'i, no problem in the lower 48) or SP Air, you are covered by Canada Post insurance up to $100 against damage or loss in transit. Phone Canada Post and make the claim.
If you used Expedited, you can give the "tracking" number in any dispute, and it should/might help the Paypal clerk to see that the item had an attempted delivery, which I believe counts in your favour.
