A common problem that might help buyers.

 

Bought a $20 item from Seller in China (190,000 positives 98.7% or so).

 

At 44 days, item has not arrived so I open a PP dispute.

 

Seller says he will resend but at 56 days, and three requests, refuses to confirm he re-sent it.  ... just replies with "dear Friend, don't worry ..."

 

I'm trying to avoid leaving my first negative rating and have an idea how to do so but can't put it to him until I know where he stands.

 

With just 4 days left to leave feedback I think he is stalling to avoid my feedback .... but I will leave feedback and escalate to a claim unless there is a development.

Escalate to a claim now. FB is less important than getting your money back and that is what the stalling is for, to avoid paying.

Demand immediate refund and threaten to escalate  to claim in 24 hours if you do not receive.

 

This usually triggers resolution, and is easier than filing claim.

The advantage of the claim is that it puts the seller in the eBay /Paypal system and flags his account.

This claim may be the one that kicks him off eBay.

 

That the purchase was 56 days ago is enough reason to go with the Dispute.

I already knew that the "pay when you get the item" from Paypal was a joke as I never got items within that time frame anyways, but now I just found out about the Feedback deadline... too late.  I think that considering, for the most part, transactions involve international shipping, the deadline is WAY to short and benefits sellers a lot.   Ebay needs to change this because once you realize that, sellers ratings are useless.  

So since I can't rate them in the appropriate place, I will tell you that  are one and the same as they used the same "copy/paste" answers to my emails with the exact same words with exact same quality of English and I have never got my products or $ back from them.

And now I just found out that ebay will edit my previous text and remove the names of the fraudulent seller... So is ebay interested in knowing when a seller is a scam?  Where do we report one?

I also read about how if the seller gave you a review, you can always go that route to review him back so I checked and that seller did not review me so I guess that is another red flag showing that they knew what they where doing all that time.

The bad news is Mods are only here to "protect E bay's interest" not the buyers ,eBay is the authority and mods are the muscles. the more the next customer is left in the dark the better off eBay will be,buyers are left to their own devices to individually experience bad sellers and must keep it to themselves.

Sure they say,contact us and we will "eventually" do something about it. a perfect example of conflict or interest.

 

The good news is you are free not to ever come back and shop here until thing change for the better .

Here is the final outcome.

 

At Day 58 I suggested the following to end the stalemate where the seller kept urging me to wait: make a refund, that will end the dispute, I will not leave any feedback.

 

Seller accepted and made the refund but also told me to" leave 5 star feedback as promised" ... **bleep** as they say.

 

I ordered the item from another eBay seller.

 

What happened to my item? I don't know and am reluctant to blame well established seller. None-the-less, I do believe he was stalling to get me past the feedback and the claim deadlines.

We are not allowed to 'name and shame" any member on these Boards. Think about how nasty people could be about you, even if they had never been involved in a transaction, if such were allowed.You may have noticed that posters tend to nickname each other, partly for this reason, and partly for giggles.

We are allowed to give transaction numbers. These also allow other posters to see both sides of a transaction. That the "excellent seller" has low DSRs , or the 100% FB buyer leaves more negative than positive feedback. Clean hands, as they say.

 

Seller accepted and made the refund 

A frustrating exercise, but at least you got your money back, well after the PP 45 day Dispute deadline.

It would also have been possible to move away from PP and eBay to settle this problem, by starting a chargeback with the credit card that PP processed for the payment. Cards have longer deadlines than eBay and Paypal.

In addition, we can add Responses to any feedback left, indefinitely. Like the most effective feedback, Responses should be calm and factual.

There is nothing forcing you to leave any feedback, positive, negative or neutral at any time. Feedback is entirely voluntary.

Sellers know that if they leave feedback, then we can respond. So this is useless because when their intention is to keep their item and your money, they just don't give you feedback.

I'm currently experiencing the same thing. It sounds like we have the same seller.....no item receive, they say they sent the refund via paypal, no refund...and all they cared about was me not leaving negative feedback...which now I can't of course....and in reading the comments to your post, the seller didn't leave feedback about me either...I still contacted PP and eBay, and an international complaint place as well....not so much to get my money back, but to red flag the seller. In my case, seller never sent item from China and I can't open pp dispute because ebay format said I can only dispute the transaction after 48 days which passed paypal and ebay time limit based on seller latest estimate delivery.

I can't do anything everytime I want to login it said I can't open dispute until certain date which definitely past 45 days since I paid

.

This is a loophole that ebay should be aware of if a buyer can only open ebay dispute and pp dispute after 45 days which allow scam seller to walkaway. I just have enough so I do chargeback right away with credit card because in my case seems ebay and paypal can't help me after 45 days.

 

Read this article below...seems now it's common for scammers to do it.

To counteract it, always pay by credit card and if somehow ebay screwed you and you can only open the dispute after 45 days then just directly open dispute or chargeback with your credit card.

Yes, as mentioned above-- and in several other similar threads-- Paypal allows 45 days for claims. Opening the claim adds another 20 days for resolution.

If the 45 days have passed, the buyer should go to her credit card. CC's have longer deadlines (as much as 120 days in some cases) but they do have deadlines.

 

Buyers especially newish members are all too often persuaded by sellers to wait for a replacement item. This is never a good idea. Ask for a refund.

If the item appears after the refund, ethically the buyer should repay the refund.

That doesn't make sound right as you should be able to make a claim before 45 days are up.

Siatiau, I'm really surprised that you didn't know about the 45 days after receiving MORE than 1000 feedbacks... if this is your first bad transaction, you were VERY lucky!

This will be my first and last purchase from ebay. Seller of a ham radio linear amp location was claimed as The Phillipines. My item did not arrive. The seller was in Minsk, Russia, not The Phillipines. With the conflict in Ukraine, my ham radio amp would be coveted by the rebels and the Ukrainians. If I was told it would be shipped from Russia, I would have never ordered it. The item was "lost" between Minsk and Vancouver. Kept on getting stalled about my refund, and the 45 day limit was almost up. I do not want to hurt the sellers rep, so I provided proof to ebay that the item was indeed shipped, and cleared Minsk customs on May 22nd, 2015. Latest date of arrival was June 16th. Called Canada Post, and they have no record of the item arriving in Canada, and the automated tracking system says in yellow writing "There has been a problem with your shipment", and Canada Post will not disclose the problem. I just got my refund, and I will NEVER use Ebay again. I feel sorry for the seller as he did everything right, but ebay insists that the item being lost/stolen in transit was HIS fault! Shame on Ebay. Thanks for the refund, but I am now closing my account.

I feel sorry for the seller as he did everything right, but ebay insists that the item being lost/stolen in transit was HIS fault! Shame on Ebay.

 

All we sellers are responsible for the secure delivery of our sold items.

Your seller in Ukraine did not choose a secure service. Not that he necessarily would have been able to find one.
