the seller has said if it's not arrived in 45 days to let them know, but I'm getting no responses. I want to get a refund but every 3 or 4 days I message them, it says "so-and-so is out of office", not the sellers name, and now I don't know what to do because that 45 day thing for the buyer protection is past

What do you do? You mean now? Now that 45 days has passed, you can no longer leave feedback, and you didn't use a credit card? Is there anything else you can do now?

Well, there is one thing you can do, -- have a good look at the following link about filing a claim:

Too late for this one, but just in time for the future. If only people were made aware of that 45 day deadline before it becomes too late. Your sly and crafty seller knew exactly what he was doing when he said "let me know after 45 days...". And I know exactly what country your seller is in without you having to say it. Some countries are much, much worse than others.
Read about what to do when an item is not as described in the listing, or when it doesn't show up at all. And never ever let a seller delay you past day 45, no matter what. File a claim if need be, and do not close it until you have either your money or your item. If the item shows up later you can always repay the seller.

I buy and Sell on eBay.
You have to be careful with unethical sellers and Buyers to minimize risk.
You must make a claim with PayPal within 45 days or you will lose you ability to get your money back. If it has been past 45 days and you can not reach the Seller I regret to say that you have gotten ripped off.
In this case your only recourse is a very bad negative feedback. Sometime this is the only way to encourage a positive cooperation from the buyer and a reply.
Become very familiar with your obligations and rights as a PayPal buyer and the making claims process.
This will make you become a much stronger eBayer.

You chose to let the deadlines pass instead of filing disputes.
There is one more deadline you may be within. If you paid using a credit card, you could do chargeback within 90 days from sale. File that ASAP.

thanks for the help, now I know for next time. but should I keep messaging the person, or just stop and just give up
