Bought an item - never received it. Contacted seller, he claimed it was returned and would re-send and give me the tracking number. Waited another week - nothing? Fire off another note to seller - no response this time. Open up a Paypal claim - seller doesn't even respond so Paypal closes the case and decides in my favour - only problem is there is no money in the seller's account? So I'm out the $$$...apparently all a scammer has to do is move the money out of Paypal and the buyer is screwed. Some Buyer Protection that is...

I always thought if a seller moves his paypal funds out of Paypal they can take the funds from a credit card or bank that's on file, is this not true?

It's a board myth, PayPal have enough brains not to leave themselves open to unauthorized use chargebacks or criminal charges for theft.

One thing which is true, if PayPal refunds a buyer out of their own pocket and the amount is sufficiently high they will come after the seller to recover the funds (ie: collection or perhaps even small claims court).

Assuming they can find the seller or the seller was actually a real person and not just a bogus shell account. In that case, they won't refund out of their own pocket, they will just screw the little guy over and over like a good money launderer would.

It's going to end badly for eBay and Paypal though, because recent discussions with several manufacturers, all of which are huge and well financed has resulted in reconsidering protecting their Trademarks, copyrights and IP against all the counterfeit goods available on eBay. I suspect this is a result of the terrible economy providing some very large companies with underutilized legal departments looking to keep busy during the meltdown.

I hope all my problems getting my $300.oo back doesn't end up costing them $300 million if these companies decide to move forward..... NOT !!!! Realistically, only 1 of the three might get to the "lets get'em" stage, but I would suspect a lot of negotiation on the part of eBay and PayPal as they probably can't withstand another counterfeit suite loss....

Looks like I have a new job, identifying probably counterfiet listings and providing them to a manufacturer so they can go after eBay and protect their trademarks, copyrights and IP. First week's canidates have been submitted for investigation by the manufacturer. At least it's at my convenience.

I guess Paypal should have refunded me long ago muhahahahah.

See, sometimes pursuing the little things can have big effects.
