Buyer received his item on December 10th, 2007.

Made a mistake and ordered an identical item from two different suppliers on Ebay. He received mine a day later than the one he ordered from the other seller.

Paid both with his Master Card.

He filed claim with Paypal indicating duplicate shipment.

He made the mistake of buying one item from me, and then buying the same item from another seller. I was nice about it and told him that I would give him a full refund if he returned my item in its' original condition. He refused to pay return shipping.

I have still not received my item back yet. (I doubt I ever will)... 😞

I provided Paypal with the tracking number from CP, which clearly states that the item was delivered to the recipient on December 10th, 2007. On time... No delay in delivery...

I got the following email from Paypal today...

As you know, we have been using the information you provided to dispute a chargeback filed against the transaction detailed below. Despite our best efforts, the buyer's credit card company decided in favor of the buyer.

Unfortunately, we do not control the outcome of the chargeback decision reached by the buyer's issuing bank in a credit card transaction. By accepting the terms of the PayPal User Agreement, you agreed to accept the decision of the issuing bank as final and legally binding for this type of dispute.


WHAT A CROCK!!

Now I am out total cost of the item, and I can't relist it, cause I don't have it. The buyer will now have two of the same units from different suppliers.

WOW LOOK FOLKS! USE PAYPAL AND YOU CAN GET TWO FOR THE PRICE OF ONE!!!

This is just nuts!!

Yes, the address was confirmed and I shipped within 48 hours of receiving payment.

The buyer confirmed via email that he did receive the item on the 10th. There is no confusion as to whether the client recieved the item, he confirmed that he recieved the item, but also, that he had ordered the very same item from my competition and stated that he didn't need 2 of the same item.

He has not returned my item to me, yet received a refund from Paypal. I forwarded a copy of his email confirming that he received my item on December 10th, to Paypal, but they still gave him a refund!! Go figure??

Do I have any recourse here?

Hm... if so that is scary indeed!

Although Paypal prefers that one pay from balance or bank account (surprise?), common wisdom dictates that one makes payments for purchases via CC (for exactly that reason).

What I don't understand is that not why we have SSP in the first place???

Are you SURE they were confirmed and that you're not confusing verified and confirmed? There is a big difference between the two. If online delivery confirmation shows delivery of the item and the address is confirmed you will be covered.

If PayPal denied the your appeal then I think you're wrong about the address being confirmed. I've had one or two claims and PayPal fought and won for me because it was a confirmed address, I shipped in 7 days and had online delivery confirmation.

that's actually wierd. it sounds as though paypal is making their decision based on the fact that it was the credit card company that charged it back, and not because recipient didn't receive, which doesn't really matter. paypal should (and does) still fight on your behalf for credit card chargebacks?!? i would call paypal and demand what the hell is going on-they're not doing their job in fighting for a chargeback for you where the recipient clearly received the item...

I just checked the Paypal listing again, and please accept my apologies, the address was 'not' confirmed, so that's why they didn't fight for me.

Based on CP's tracking #, it was delivered to the address specified, (but not confirmed), on December 10th, 2007... 😞

Ok, enough said, I will let this one drop, and chalk it up to experience as they say...

This is exactly why many sellers don't accept payment from unconfirmed addresses. Sorry it happened to you.

This happened to me in the past several times. The buyer buys something I have and finds one cheaper a few days later and buys that one. I usually never hear from this person ever again and file a non payment dispute but to date, never had anyone do a chargeback. Good luck.

Hi,

I don't think you actually have to worry much. At first, paypal informs you that the chargeback is at the buyer's favor, and close the chargeback. However, if you send the item to the mentioned address providing a tracking number, paypal will reopen the chargeback and investigate it 2 or 3 weeks later.
