Hi! I recently won a auction for a Iphone 3gs-16Gb.contacted seller saying I would pay for item in the next 24-48 hours .his answer was i had 12 hours to pay for item.I payed in the 12 hours and received it on the dec 24 got home from work opened the package and activated it finding out it was a 3gs-8GB. I contacted seller and he wanted to see some pictures of the phone cause he didnt believe me. I attached a picture to prove it was a 8GB instead of a 16GB and never got a answer back. I have purchased several items off ebay but dont know what to do as he states item cannot be returned , but item was not as described.can anyone help with this situation or send me in the right direction

You can return the item
In your case you should probably open a case and then use expedited shipping.
I would also ask the seller to pay return shipping because the item is clearly not as described.
The seller probably won't agree but make it clear to the seller that it is what you expect prior to returning the item.
That seller has 4.7 for item as described so you are obviously dealing with a problem seller and even though you can eventually leave NFB I have a feeling that this is a seller who does not care too much about that.
Just curious: How was the item shipped to you?

Everything is returnable, Paypal says so. SNAD is SNAD. You did not get what you paid for.
I doubt the seller did not believe you, they may simply need the picture to figure out what they did. Maybe switched boxes? Maybe they did a |sell similar" and did not change the description? Perhaps they did change the description but eBat did not update correctly.
All of those scenarios have happened to me. Show me what you got and I can figure it out. Not replying is not a good idea, on their part.
Have you started the SNAD seeing as how they have not replied to you?

It sounds like very expensive shipping.
The seller will have to refund that as well when you return the item.
There is a good chance that the seller will offer you a partial refund rather than do a return especially if shipping was high.
If that is something that would appeal to you then if the seller does not suggest it first there is nothing wrong with bringing it up rather than spending more money to return the item.
I absolutely hate when I'm forced to throw good money after bad because a seller forces me to return worthless items.
Since the seller is not responding you may have to file a case to get the seller's attention.

He should but he is not required to by Paypal. Nor will PP refund return shipping if they have to force the refund.
While a partial refund may be the best solution, the OP should be aware that sellers are wary of buyers who demand partials after the fact. And unfortunately, the seller is often the victim of fraud in partial refund cases.
However, the OP wanted 16 Gs and got 8Gs, so he may not want to second rate phone at all.
OP you should be aware that many of the sellers of electronic devices are offering shopworn or returned items, that may not be in their correct original packaging. He may not have been aware of the problem- although he certainly should have double checked, especially since his Description DSR is so poor.

Sellers are required by paypal and ebay to refund the buyer's initial payment including shipping when refunding.
They are not required to refund return shipping although many do depending on the circumstances.
