Hi
I recently bought a item from a seller from the UK and when it arrived (I'm in Canada) it appears that the seller sent me the wrong item now my question is when I file a case for return it didn't include the border custom charges that I had to pay on my end separately how is this normally dealt?? The refund amount shows only item + shipping amount so if I did get the refund that means I would have to ship it back to him which is an additional cost I would have to lose?? Since its not my mistake should I be getting back (Item + Shipping + Shipping back cost + Custom cost)?? I'm not too familar with ebay but I'm hoping that I shouldn't be losing any $ for a mistake that the seller make. Thanks in advance

First contact the seller.
Ask if she will cover the return shipping, and if so, if she could send you a shipping label from Canada Post.
She is entitled to refuse. She may not be able to send you a useable shipping label from the UK.
Standard Practice, based on Paypal/eBay's policies, is that the buyer pays return shipping.
Best Practice is that the seller pays it, if the error was hers, as is this case. But again, it is voluntary.
(Your enforcement tools are feedback and Detailed Seller Ratings, but don't mention this. Not only is it counter-productive at this point, but mentioning these can work against you with eBay if it comes to a Dispute.)
Since you paid the import fees, the seller has no responsibility for them. You should phone the local Canadian Border Services office and ask how you should go about getting them refunded when you are returning the item.
You will not be refunded Canada Post's $10 service fee. Period.
Sigh. Very complex. Let's hope the UK seller is willing to replace without demanding a return. Some sellers will accept a photo of the problematic purchase.
And just to play devil's advocate. This is where the Global Shipping Program has it all over normal shipping. The GSP does not demand returns for refunds, provided you choose the 'right' reason for wanting the refund. *dons her asbestos Stanfields*

If you paid the customs charge at the time that you purchased the item then you purchased it through the UK gsp program and you should receive those fees back. You may have to phone ebay about it if you are not refunded all of your money. A seller is supposed to be liable for return shipping if the item was not as described and they want the item back however, I don't know if that will be valid for an international transaction.
Based on the feedback you've given, you seem to have problems with quite a few transactions. You might want to have a look at the seller's feedback before you make the purchase to see if they have had a lot of complaints.

Hypothetically, if it was a GSP item and it was a seller fault, the GSP has no involvement in returns and refunds.
The only way you'd get a refund is if the wrong item was sent by the GSP. That is, if the GSP center messed up and switched two customer's packets. In such a case there is no need to return the item, the buyer just keeps the wrong item to dispose of or use as they wish.
This may be adding confusion for the OP, but I thought I'd just correct the GSP point.

Perhaps you know of specific times when this happened but any time that I've heard of a problem like this, the buyer was refunded in full regardless who was found at fault...PB or the seller.
If a buyer wants to return an item for buyers remorse, then they do not receive a refund for fees paid to PB.

We have both seen reasonably well documented cases where the 'victim' of a completely wrong item was refunded, where PB had transposed items and buyers but in the event of a seller sending the wrong item to the right person and there was no fault in shipping this would be a seller fault return, which in the terms is not covered in any way by PB.
Any cases of seller fault return (not as described or seller sent totally wrong item) where the buyer got any help from the GSP would be interesting.
It should be remembered that this specific case may or may not be a GSP item, only the OP can say.

afantiques-- since you are in the UK, can a UK resident send a mailing label to Canadian resident? I suppose a Canada Post label would be most useful.

No, not possible.
The seller would have to send money, probably through Paypal, as a 'gift'.

Thanks for all the great response! I'm working with seller on the refund right now. I have another question should I wait to get the full refund issued first before I ship the Item back to him???

Usually the seller wants to have the item in hand before refunding.
Nothing personal, but some buyers have kept the refund(and return shipping) and not returned the item. Just as some sellers have kept the item without refunding.
The buyer is better protected here, because, if the seller can show delivery (tracking/ Confirmation of Delivery) then Paypal will help be completing the refund and going after the seller for their money. Hard.
It all comes down to trust.
And most people are honest.
