Seeking advice on what to do on this case.

After a long exchange of trying to find resolution, a chinese seller & I agreed that he/she will give me my half refund first (he/she initially wanted me to leave positive feedback first) then for me to leave positive feedback before he/she refunds me the rest.

The first half has been refunded, I've left a positive feedback but it's almost 2 days and I haven't received the rest of the refund nor heard back. During our previous conversations it only took him a day or less to respond (which I beleive is due to timezone) now I feel like tricked.

Can I still pursue him/her? Will I still be protected by paypal/ebay? I still have our agreement conversation saved on my ebay account and personal mail. Any advice?

What happened here is feedback extortion, and it is again eBay's rules.  You should contact eBay and explain the situation and you should be able to get the rest of your money back and eBay will most likely remove the feedback. 

 

You have 45 days from the purchase date to open a dispute, but you can still report a seller after that.

Stop communicating with this scammer.

File the Dispute.

You only have 45 days from purchase for this.

I suspect the scammer kept you talking long enough for this to be impossible.

 

So.

 

Go to the credit card you really paid with. Paypal is just the mediator. Call the 1-800 number for the card and ask about a chargeback.

Have all your paperwork handy. Dates, payments, transaction numbers, etc.

If you received something, you may be asked to send it back. Some cards do that, others don't.

While cards have longer deadlines than eBay/PP, they do have deadlines so act immediately.

 

In future,

When there is a problem, act within the 45 day deadline.

The first step is to contact the seller.

He is entitled to have the unsatisfactory product back. If you are returning it, use a tracked service and Air Mail. Don't expect any refund on this.

But that is not the end.

If the seller does not refund the original payment on contact, or if returning the item will take you past the deadline, open a Dispute.

Give the tracking number in the Dispute.

If the seller still does not refund, PP will and go after him for their money. He will have other fallout.

Try to make this into a funny story for your 50th anniversary party.

 

FWIW- the Chinese gowns are about the same quality as those offered in the Sears catalogue. For under $200.

 

And check Canada 411 for a local seamstress who sews.  A pattern (Vogue are gorgeous , Simplicity are easy to sew), fabric, and some lace , should take about two weeks to produce, based on my late mother's scheduling. Cost should be under $1000 depending on fabric chosen.

I gave him my last message today saying I'm still waiting for the rest of the refund.

Unfortunately, I did not use credit card so I can't do a chargeback.
But fortunately, the sale date was only last month the 15th, only 28 days ago.

The problem now is that there is no category for this kind of case on eBay. On Paypal however, I managed to send a personal email earlier detailing the case. Although I'm not sure that was the correct place to send it. I'll know when they reply.

It would be best to call eBay customer service, and they can help you over the phone.  Try this link and click on call us on the right hand side, and phone customer service and explain everything to them.
