Seller sent me a fake then sent ANOTHER person's tracking number.

Hi everyone! I'm fairly new to ebay so I have a question that may already have an answer and I just couldn't find it.

So I bought a phone on January 12th, had my payment processed 5 days afterwards (processed on a weekend) then apparently shipped on the 20th of January. Okay, so the ETA of my package is February 19 and so this is what happened:

 

The package coming from Guangzhou, China was sent via China Post and we all know how fast that service is, right? I asked for a tracking number and after a day, I received a non-working one. The seller insisted that it was correct, but THEN gave me another tracking number the next day. Okay, tracking this package for two weeks and it finally arrives in Canada, but the package went to another city and was stated as "Delivered". I called Canada Post about the package and they said that the tracking number's address was totally different from my personal address. I got another email from Canada Post that the package was signed and was signed by Mike __________ and in NO WAY am I related to the name or the address.

 

I've contacted the seller about it and they said they'll check for me, refund or resend the package if it was their fault. They're usually speedy about responding, but they stopped responding (it's been 48 hours only). Now, I just want a refund of my money (or resend via DHL out of my pockets) because I'm unsure if the package is even coming and also if I do get another tracking number, will it be for another Mike __________? 

 

What should I do? I just want my money back.

You should go to ebay's resolution centre and file as "item not received". If the seller has stopped communicating it is very likely he wouldn't send another item anyway. Do this now, you only have 30 days to file and get your money refunded.

Go to the resolution Centre at the bottom of your page. Open an Item Not Received Dispute.

You have already done the first step (contact seller) so go on to Step Two and escalate as soon as possible.

Why out of your pocket when the mistake was not yours?

It isn't.

It is quite possible that the item you paid for never existed and was never sent.

Certainly no replacement will ever arrive.
