Leave negative feedback for the item. There is only so much space, so word carefully. You could open an "item not received case" if he refuses to refund you. You don't have to wait the specified time, I opened one up in a couple of days. I'm in the same situation now and have an case open. The only difference being seller won't refund or ship, and relisted and sold the item. Waaay too much of this going on in E-bay right now and this type of situation is very hard to report with the standard reporting choices.
