Yes she can get away with it. All you can recover is your original payments. On the other hand , if it is clearly the seller's error , they should take responsibility. Buyer's have a powerful tool in leaving feedback with low DSRs which can impair a seller's ability to list. 1 is lowest.

Hi..
Even if you filed a claim with PP (PayPal) a SNAD (Significally Not As Describe) claim PP will ONLY refund the original price of the item and the original price of the shipping...NOT ANY return shipping cost.
Think on it when you buy a item from your local store and it does not work and you take it back to the local store do they pay you for your time, gas, wear and tear on the auto? No they don't that s the same way it work here.

What to do if you don't receive an item or it doesn't match the seller's description

Returning an item
If you'd like a full refund, you'll generally be required to return an item. Here are some things to keep in mind:
Don't send an item back unless the seller or eBay asks you to.
Package the item carefully and securely with all parts. The seller must receive the item in the same condition as you received it.
When you send the item, you'll need to include tracking information. For items worth $250.00 or more, signature confirmation is required.
Important: If you refuse delivery of an item so you won't have to return it, the item won't be covered by eBay Buyer Protection.
