I send a request to cancel the transaction. BUYER live in a country ,where I can not to ship items. The buyer does not agree to cancelling transaction . I found a way to to send the item with privet mail. But buyer does not want to cancel the deal ,and does not want to pay. Can I open unpaid item case? Thanks for the help.

Hi from Canada.. Not if buyer denied the cancel filed. Can't file twice on same item.
Have you adjusted exclusions.

As heidi says, you can file Unpaid or Mutual Cancellation, but only one.
Since the buyer has not paid, there is no reason to ship to him.
After 60 days, he will no longer be able to leave feedback. Stop communicating and hope that he forgets about it all.
If he does leave feedback, you can Respond. The most effective Responses are calm and factual.
"He did not pay. I did not ship." Responses, unlike feedback, are not required to be positive.
Your feedback will be read by future customers. Always try to appear professional.

First, set your buyer requirements in My Ebay > Account > Site Preferences to block bidders in countries you do not ship/post to.
While there, set your requirements to block bidders with 2 or more unpaid item strikes in the past 12 months.
In your situation, the unpaid item dispute should have been filed instead of the transaction cancellation. Once you have your blocks in place, you will not this problem with bidders outside your shipping area.
