broken DVD case

Do sellers need to mention that the case to the DVD they are selling is broken even if the item is unopened and brand new?  I have purchased quite a few dvd seasons on ebay for this xmas for my husband and i wondered if there was something wrong with them for the price i got them for.  Turns out I have received two seasons with broken cases (from 2 diff sellers).  both came in bubble wrap so its unlikely they were damaged during shipping. How am i supposed to give this as a gift to someone?!

If it were cracked it should be mentioned, but cases are rigid and fragile. I've managed to break a case while wrestling it out of the cellophane.

Bubblewrap helps, but is less than perfect. Remember that your package is on a conveyor belt with parcels weighing up to 25kilos, and may drop 50 cm from one belt to another  followed by that heavy box.

Are the discs themselves okay? The artwork?

Is this a First World Problem?
